1960-5806RESOLUTION NO. 5806 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX CHAPTER 2 OF THE ANAHEIM MUNICIPAL C ODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commissien of the City of Anaheim has heretoforM duly pas and adopted a resolution declar- ing its intentioe to change the boundaries of the zone or zones hereinafter mentio ed and de c ar d did fix time and place for the holding of a public hearing thereon in th manner and as prescribed in Articl .IX Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public h ring to co sider said proposed change of zone .r zone 9 and did r cei °e evidence and reports from persons int r sted therein and WHEREAS within a period of forty (140) days following the final hearing thereon the Planning C mmi lion did duly announce by formal resolution it findings of facts, and declare its opinions and reasons f r= ;commending En amendment to said Article IX Chapter 2 of the Anaheim Municipal Coda to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described, :.red WHEREAS, upon r -cwipt .f the r p "rt and recommendation of the City Planning Commission th City Council did thereupon fix the 9 day f rab 9 19 60 as the time and the Council. Chamber in th ty Wail of th `ity of Anaheim as the place for a public hearing up said p °oposc d change of zone, and did give notice thereof in the m =Inner and as provid (vd in said Article IX Chapter 2 of th-; Anaheim Municipal Cod© and WHEREAS at the time and place fixed for said public hear ing the City Council did duly held and conduct =uch public hearing and did give all person interest therein an spportunity to be heard and did receive evide :,cca and reports, and did thereupon con- sider the recommendations of the City Planni:•,g Commissions and WHEREAS, the City Council does find and determine that the property a are proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth is more suitable for th zone or zones to which it is proposed to change said property and area and that the inclusion of said prop arty and area in such new zone or z.ne will increase the value of said property and area and will ,.iot depr elate the values of prop- erty in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by th City Council of the City of Anaheim that all of the property and are situated in the City of Anaheim, County of Orange State of California, described as follows; to wit; F- 59 -60 -;0 ATTEST: CL The Easterly 115.73 feet of the Westerly 385.73 feet of the Northerly 165.00 feet of the North- west quarter of the Northwest quarter of the Southwest quarter of Section 17, Township L South, Range 10 West, S. B. B. M. be changed from R -A, RESIDE1'TIAL- AGRICULTURAL ;ONE. to C -.l NEIGHBORHOOD COMMERCIAL ZONE a upon the following conditions: 1. That the owners of subject property place of record standard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney. 2. That the buildings to be constructed on subject property be erected essentially as shown on the Amended Plot Plan and Rendering signed this day by Mr. Morris and filed with the City of Anaheim. 3. That the owners of subject property deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Orange Avenue, for street widening purposes. L. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 5. That the owners of subject property pay to the City of Anaheim the sum of W2.00 per front foot, along Orange Avenue, for street lighting purposes. 0. That all of the above conditions, with the exception of Condition 2 and Lr(a) be complied with within a period of 90 days from date hereof, or such further time as the Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
