1960-5805WHEREAS, the City Pl_. i g Commission r the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the bound .:vies of the zone or zones hereiraaftr mentioned and described -,nd did fix a time and place for the holding of a public hearing thereon in thy=, manner and as pre:- crib -d in Article. IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public h ;:ring to consider said proposed change of zone or ZO:; and did recei a evidence and reports from persons interested therein; and WHEREAS, within a period of forty (14.0) days following the final hearing thereon, the Planning Commi. -sion did duly announce by formal resolutit =n its findings of f cts and declare its opinions and reasons for r ©amanending an a endment to s id Article IX, Chapter 2 of the Anaheim Municip 1 Code t affect the proposed changes in the boundaries of the zone hereinafter me ntioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, th City Council did thereupon fix the th day of Februa 19 b as the time and the Count Chamber in the City 1�a 1 of the City of Anaheim as the place for a public hearing up ,•n said proposed change of zone, and did give notice thereof in the manner r nd as providt,d in said Article. IX, Chapter 2 of the Anaheim Municipal C e:; and WHEREAS, at the time and place fix d for said public hear= ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an ,pportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and are proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop erty and area in such new zone or z ne will increase the value of said property and area aed will not d_preciate the values of prop- erty in adjoining zone o NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim th:= t all of the property and rea situated in the City of Anaheim, County of Orange, State: of California, described as follows to wit A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE, RESOLUTION NO. 8 0 F- 59 -6O -69 ATTEST: Lots 11 and 12 of Smith and Deants Re- Subdivision of the Southerly 404 feet of Block "A" Hotel Del Campo Tract, as shown on a map recorded in Book 4, page 31 of Miscellaneous Maps, records of Orange County, California. be changed from R 3. MULTIPLE- FAMILY RESIDENTIAL ZONE, to C -1, NEIGHBORHOOD COMMERCIAL ZONE D upon the following conditions: 1. That the owners of subject property place of record standard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of the property to Banks, Business Officies, Medical and Dental Offices, Pharmacies, Professional Offices, Non- Retail Service Businesses, and any uses, except Restaurants, which may here- after be authorized and permitted under future zoning of the City of Anaheim in the proposed C -7, Business and Professional Office Zones, and which restrictions must be approved and recorded in the Office of the County Recorder prior to the issuance of a business license for any of the above mentioned uses. 2. That the garages now located on subject property be removed, and that the rear protion of the property be black- topped for parking. 3. That the sidewalks and curbs be repaired and/or replaced as required by the Director of Public Works and Superintendent of Streets, and in accordance with standard specifications of the City of Anaheim. 4. That the owners of subject property pay to the City of Anaheim the sum of '2.00 per front foot, along Melrose Street, for street lighting purposes. 5. That Condition No. 4 hereof be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper, THE FOREGOING RESOLUTION is signed and approved by me this 9th day of February 9 19 60 0 CLERK OF THE CITY OF ANAHEIM =2- STATE OF CALIFORNIA COUNTY OF ORANGE ss.
