1960-5793RESOLUTION NO. 5793 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1180. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Robert H. Naaee Authorize Agent, and Ross W. Cortese, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lot 1 of Tract No. 1940, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 82, Pages 8 through 10 inclusive of Miscellaneous Maps, in the Office of the County Recorder of said County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on December 21 19 59 notices of which said public hearing were duly given as re- quired by law and the provisions of Section 9200,17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 136 Series 1959 -60 denying Variance No 1 and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying_______said variance, and said appeal was set for public hearing on February 2 19 Ap at 7 :00 otclock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provi- sions of Section 9200,17 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and de- termine that 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone, -1- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Variance No. 1180 requesting permission to construct and operate a retail grocery store on the property hereinabove des- cribed be, and the same is hereby sustained and that Variance No. 1180 be, and the same is hereby denied.
