A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly p -.ssed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentioned :_nd described and did fix time and place for the h `Ldin,g of a public hearing therf on in the manner and as prescrib =d in Article IX Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct such public hn ring to consider said proposed change of zone or zo 3 $a, and did r -oeive evidence and reports from persons intereste therein; and WHEREAS, within a period of forty (14.0) days following the final he ring there the Planning Commission did duly announce by formal resolution its finding of fagots nd deolar°e its opinions and reasons for r°= .comm nding Ea a th ent to said Article IX Chapter 2 of the Anaheim Municipal Code to effect the proposed change, in the bc_undar°ies of th z *nc: hereinafter mentioned and described; and WHEREAS, upon receipt of the r pert and recommendation of the City Planning Commission, the City Council did thereupon fix the 26th day of January 1,960 v as the time and the Council Chamber in the Cityai ®f thty of Anaheim as the place for a public hearing up *;n said proposd. ohange of zone, and did give notice thereof in the manner nd as prop: idcd in said Article IX, Chapter 2 of the Anaheim Municipal Cod 9 and WHEREAS, at the time and piaoc fixed for said public hear= ing, the City Council did duly hold and conduct such public hearing and did give all persons intere ted ther<s,in an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendation: of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop erty and area in such new zone or zone will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim thc_t all of the property and are situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: That portion of the Southeast quarter of the Southwest quarter of Section 9, Township 14. South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in Book 51, Page 10 of Miscellaneous F- 59 -60 -68 Maps, in the office of the County Recorder of said county, lying northerly of the Northeasterly line of the land described as Parcel 5, in the Lis Pendens in Case No. 41023 filed November 10, 1942, in the Superior Court of the State of California, a copy of which is recorded November 10, 1942 in Book 1170, Page 140 of Official Records, included within the following described land: Beginning at a point on the South line of said Section 9, East 606.95 feet from the Southwest corner of said Southeast quarter; thence North 823.48 feet parallel with the West line of said Southeast quarter, to the South line of the Anaheim Homestead Tract, as per map recorded in Book 26, Page 10 of Miscellaneous Records of Los Angeles County, California; thence East 401.18 feet along said South line; thence South 821.59 feet to the South line of said Section 9; thence West 401.70 feet along said last mentioned South line to the point of beginning. EXCEPT the West 261.00 feet thereof. ALSO EXCEPT that portion thereof included within the following described land: Commencing at the Southwest corner of said Southeast quarter; thence North 89 141 25" East 606.95 feet; thence North 0 1 50" West 661.64 feet along a line parallel with the West line of said Southeast quarter to the point of intersection with the Northeasterly line of land described as Parcel 5 in the Lis Pendens in Case No. 41023 filed November 10, 1942, in the Superior Court of the State of California, a copy of which is recorded in Book 1170, Page 140 of Official Records, said point of intersection being the true point of beginning; thence continuing North 0 11)1 50" West 46.32 feet to a curve, concave Southwesterly, .and _having a radius of 3528.00 feet; thence Southeasterly 151.07 feet along said curve from a tangent which bears South ?3 401 51" East through a central angle of 2 27' 12" to a point of tangency thereof with a curve, concave Southwesterly, having a radius of 2028.00 feet; thence continuing Southeasterly 280.57 feet along said curve through a central angle of 7 551 36" to a point in the Easterly line of land described as Parcel 2 in deed to Randolph C. McKinely and wife, recorded March 7, 1946 in Book 1373, Page 584 Official Records, distant thereon North 0 43 18" West 77.70 feet from said North- easterly line of the land described as Parcel 5 in said Lis Pendens; thence along said Easterly line, South 0 431 18 East 77.70 feet to said Northeasterly line; thence along said Northeasterly line, North- westerly 111111.09 feet along a curve concave Southwesterly and having a radius of 2500.00 feet through a central angle of 10 10 40" to the true point of beginning. be changed from R -A, RESIDENTIAL AGRICULTURAL ZONE to C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That plans for the development of subject property shall be submitted to and approved by the City Council, and that said plans shall include the landscaping. -2- 2. That all buildings erected on subject property shall be limited to one story in height. 3. That the owners of subject property place of record standard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the C -1 uses of the property to Banks, Business Offices, Medical and Dental Offices, Pharmacies, Professional Offices, Non Retail Service Businesses, and any uses, except Restaurants, which may hereafter be authorized and permitted under future zoning of the City of Anaheim in the proposed C -7, Business and Professional Office Zones. L.. (a) That sidewalks shall be constructed along Wilshire Avenue as required by the City Engineer and in accordance with standard specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said sidewalks. That parking on subject property shall not be per- mitted within ten (10) feet of the wall to be erected at the rear of said property; but that trees shall be planted in this ten -foot area to act as a sound barrier. 6. That area lighting shall be maintained below the height of the wall to be erected at the rear of the property. 7. That there shall be maintained a 25 -foot minimum rear yard building setback. 8. That the owners of subject property pay to the City of Anaheim the sum of $2 per front foot for street lighting purposes. 9. That Conditions Nos. 1, 3, .(b) and 8 above mentioned be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
