A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 5659 IN.
RECLASSIFICATION PROCEEDINGS NO. F- 59- 60 -44.
WHEREAS, the City Council did heretofore, to wit, on
December 1, 1959, adopt Resolution No. 5659 in reclassification
proceedings No. F- 59- 60 -44, upon application from Robert J.
Drabkin and Harvey A. Glaser for a change of zone of certain
real property described in said application; and
WHEREAS, Condition No. 2 of Resolution No. 5659
reads as follows:
"2. That the owners of the property place of
record standard City of Anaheim C -3 deed
restrictions, approved by the City Attorney,
which restrictions shall limit the use of
the property to a service station only."
AND WHEREAS, the agent for said applicants has re-
quested that the standard City of Anaheim C -3 Deed Restrictions
mentioned in Condition No. 2 of said resolution be amended by
eliminating therefrom certain of the conditions, covenants or
restrictions, and by modifying Condition No. 4. of said
restrictions; and
WHEREAS, the City Council does find that said
restrictions should be amended by deleting therefrom condi-
tions No. 2, 5 and 6, and by amending condition No. L thereof;
and
WHEREAS, the City Council does find that Condition
No. 2 of Resolution No. 5659 should be amended to permit the
above mentioned changes; and
WHEREAS, the City Council finds that an ordinance
has never been adopted directing said change of zone and
completing said proceedings;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the standard City of Anaheim,
C -3 Deed Restrictions mentioned in Condition No. 2.of Resolu-
tion No. 5659, and which the owners of the property described
in said resolution are required to place of record, be and
the same are hereby amended as follows:
1. That Conditions No. 2, 5 and 6, reading as
follows:
"2. All buildings shall be masonry or similar
fire resistant materials.
"5. A minimum of this property, exclusive of
streets, shall be maintained for customer
and service parking as required by the
Anaheim Municipal Code.

"6. No wall or fence shall enclose any
portion of the customer parking area
to the exclusion of adjacent parking
areas."
be and the same are hereby deleted from
said restrictions.
2. That Condition No. 14. of said restrictions be,
and the same is hereby amended to read as
follows:
"14 No building shall be used for residential
purposes on this property unless rezoned.
The uses of this property shall be limited
to a service station or any C -2 uses."
AND BE IT FURTHER 'RESOLVED that Condition No. 2 of
Resolution No. 5659 be and the same is hereby amended to read
as follows:
"2. That the owners of the property place of
record City of Anaheim C -3 Deed Restric-
tions, approved by the City Attorney,
which restrictions shall limit the uses
of the property to a service station or
any C -2 use."
BE IT FURTHER RESOLVED that in all other respects
said Resolution No..5659 be and remain in full force and effect.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an amendment to Article IX, Chapter 2 of the
Anaheim Municipal Code to amend said Anaheim Municipal Code to
accomplish the object herein found and determined to be
necessary and proper.
THE FOREGOING RESOLUTION is signed and approved by
me this 12th day of January, 1960.
