1960-5743RESOLUTION NO. 5743 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1178. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Mira Flores, Inc., Agent and James P. Crawford, Phyllis J. Crawford, Paul F. Neubauer, Serepta A. Mohn, Lawrence L. Brummett, Doris Brummett, Ben Ter Beest, Eva Ter Beest, Henry D. Bielefeld and Matilda Bielefeld, Owners of certain real property situated in the City. of Anaheim, County of Orange, State of California, described as follows: PARCEL 1: The Southwest Quarter of the Northeast Quarter of the Northeast Quarter of Section 21, Township 4 South, Range 10 West of the San Bernardino Meridian, in the County of Orange, State of California. PARCEL 2: The Northwest Quarter of the Northeast Quarter of the Northeast Quarter of Section 21, Township 4 South, Range 10 West of the San Bernardino Meridian, in the County of Orange, State of California. PARCEL 3: The Southeast Quarter of the Northeast Quarter of the Northeast Quarter of Section 21, Township 4 South, Range 10 West, in the Rancho San Juan.Cajon de Santa Ana, County of Orange, State of California. PARCE he Northeast Quarter of the Northeast Quarter of the Northeast Quarter of Section 21, Township 4 South, Range 10 West of the San Bernardino Meridian, in the County of Orange, State of California. PARCEL TH Quarter of the Southeast Quarter of the Northeast Quarter of Section 21, Township 4 South, Range 10 West of the San Bernardino Meridian, in the County of Orange, State of California. PARCEL 6: The Southwest Quarter of the Southeast Quarter of the Northeast Quarter of Section 21, Township 4 South, Range 10 West of the San Bernardino Meridian, in the County of Orange, State of California. PARCEL 7: Beginning at the Northwest corner of the Northwest Quarter of the Southeast Quarter of the Northeast Quarter of Section 21, Township 4 South, Range 10 West of the San Bernardino Meridian, in the County of Orange, State of California, and thence Southerly 344.06 feet to a point; thence Easterly 647.70 feet to a point; thence Northerly 344.06 feet to a point; thence Westerly 647.70 feet to the point of beginning. -1- AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on December 7, 1959, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 125, recommend- ing to the City Council of the City of Anaheim that Variance No. 1178 be granted upon the conditions stated in said resolution; and WHEREAS, the City Council does find that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to construct a 1200 unit hotel, reaurant, coffee shop, ballroom, banquet and convention rooms, cocktail bar, a 5,000 capacity stadium for aquacade shows, and a 9 hole golf course upon the property hereinabove described, upon the following conditions: 1. That the owners of subject property deed to the City of Anaheim the following property for street widening purposes: (a) A strip of land 53 feet in width, from the center line of the street, along Ball Road; (b) A strip of land 57 feet in width, from the center line of the street, along Walnut Street, from Bali Road to a point 1,320 feet South of Ball Road; (c) A strip of land 45 feet in width, from the center line of the street, along Walnut Street from Cerritos Avenue to a point 1,320 feet North of Cerritos Avenue; L- (d) A strip of land 45 feet in width, from the center line of the street, along Cerritos Avenue; (e) A strip of land 45 feet in width, from the center line of the street, along West Street. 2. That sidewalks be installed along West Street as required by the City Engineer and in accord- ance with standard plans and specifications on file in the Office of the City Engineer, and that no sidewalks be required along the other streets at this time. 3. (a) That all engineering requirements of the City of Anaheim, along Ball Road, Wainut Street, West Street and Cerritos Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work, be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 4. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot along Bali Road, Wainut Street and Cerritos Avenue for street lighting purposes, and that said street lighting requirement may, at the option of the applicants, be included in and made a part of the engineering requirements of the City of Anaheim. 5. That a solid masonry wall of a minimum height of 4 feet, be erected and maintained on the property line along Ball Road, and that the area between said wall and the curb face be landscaped. 6. That a solid masonry wall of a minimum height of 6 feet, be erected and maintained along Walnut Street, not less than 20 feet from the curb face on said street, and that the area between said wall and the curb face be landscaped. 7. That the dwelling now located on subject property, in which Mr. Neubauer has a life tenancy, shall remain on said property until the death of Mr. Neubauer, after which it shall be removed and the area on which it is now located shall be converted to a parking lot. 8. That subject property be developed in accordance with the revised layout plan this day submitted to the City Council by said applicantsand on file with the City of Anaheim, except that the northerly curb opening shown on Walnut Street on said plan, shall be omitted. -3- 9. That no license shall be issued for the operation of any use of the property, except- ing the golf course, until the applicants furnish the City Council information as to the operator of the hotel to be erected on subject property and receive approval of such operator. The City Council hereby reserves the rightto revoke such variance permit for good cause or failure of the owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 12th day of January, 1960.
