1960-6113RESOLUTION NO. 611 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Plan .w,i:;g Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public heari thereon in the manner and as prescribed in Artiole.IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct su.h public hearing to consider said proposed change of zone or zoaeE, and did reap ive evidence and reports from persons interested therein and WHEREAS, withi.i a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its finding. of f et s and declare its opinions and reasons for rec mmending an am n, t said Article IX Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission the City Council did thereupon fix the 21st day of June 1960 as the time and the Counc Chamber in the it a 1 of thirUfty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article. IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop erty and area in such new zone or zones will increase the value of said property and area and will :®;ot depreciate the values of prop- erty in adjoining zones. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: F-.59-60-106 The East 245 feet of the North half of the Southeast quarter of the Northeast quarter of the Northeast quarter of Section 27, Township 4 South Rang 10 est, S.B.B. M. be changed from R-A, RESIDENTIAL-AGRICULTURAL CULTUR,`!L ZONE to R -3, MULTIPLE-FAMILY RESIDENTIAL ZONE and C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1, That the owner of subject property record a subdivision map of said property in the Office of the County Re- corder of Orange County, or BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper. THE FOREGOING RESOLUTION is signed and approved by me this 28th day of June, 1960. ATTEST: A. Deed to the City of Anaheim a strip of land 5 feet in width from the center line of the street, along Haster Street, for street widening purposes. B. (1) That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as re- quired by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (2) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. C. Pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 2. That the owner of subject property place of record standard City of Anaheir. R -3 and C -1 Deed Restrictions, covering the respective areas, approved by the City Attorney. 3. That the owner of subject property pay to the City of Anaheim the sum of $2.5.00 per dwelling unit, to be used to for park and recreation purposes; said sum to be paid at the time the building permit is issued. 4. That Condition No. 1, or Conditions A, B(2) and C, and Condition No. 2 above mentioned be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant.
