1960-6112A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE, WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Artiole.IX, Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct such public hearing to consider said proposed change of zone or zone and did rceive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) day following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of fact.: and declare its opinions and reasons for recommending :-n amendment ti said Article IX, Chapter 2 of the Anaheim Municipal Code, to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and RESOLUTION NO, 6112 elo WHEREAS„ upon receipt of the r_:port and recommendation of the City Planning Commission, the City Council did thereupon fix the 21st day of June 19 60 as the time and the Counc Chamber in the yiraTI of thTty of Anaheim as the place for a public hearing upoi said propos -d change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said props arty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: Lots 26 and 28 of Anaheim Home Tract in the City of Anaheim, County of Orange, State of California; F -59 -60 -102 be changed from R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE TO C-1, NEIGHBORHOOD-COMMERCIAL ZONE, upon the following conditions: 1. That subject property be developed substantially in ac- cordance with the plans presented to the City Council and on file with the City of Anaheim. 2. That an area 10 feet in width be landscaped and said land- scaping maintained along both Swan and Homer Streets. 3. That the owner of subject property deed to the City of Anaheim a strip of land 32 feet in width from the center line of the street along Homer Street for street widening purposes, and grant fee title to the westerly half of Swan Street, which is 20 feet in width from the center line of the street, to the City of Anaheim. I]. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot, along both Homer and Swan Streets, for street lighting purposes. 5. (a) That all engineering requirements of the City of Anaheim along Homer Street, such as curbs and gutters, side- walks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 6. That the owner of subject property place of record standard City of Anaheim C-1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of the property to business and professional offices only. 7. That conditions Nos. 3, 4, 5(b) and 6 be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
