1960-6109RESOLUTION NO. 6109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 5634 IN RECLASSIFICATION PROCEEDINGS NO. F-59-60-36. WHEREAS, the City Council did on November 17, 1959 adopt Resolution No. 5634 in Reclassification Proceedings No. F-59-60-36, upon application from George N. and Mary Jewell Watts, finding and determining that the prop?rty therein described should be changed from the zone in which it was incorporated to different zones, as more particularly set forth in said resolution; and WHEREAS, the applicants for said change of zone did on or about April it!, 1960 file an amended application with the City Planning Commission requesting that the size of the aroas proposed to be reclassified to C-3 and C-1 zones in Reclasoifi- cation Proceedings No. F-59-60-36 be changed; and WHEREAS, the City Planning Commission of the City of Anaheim did fix a time and place for the holding of a public hearing upon said amendment to Reclassification No. -59-60-36 in the manner and as prescribed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed amendment to said Reclassifi- cation No. F-59-60-36 and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, tbe City Council did thereupon fix the 28th day of June 1 1 as the time and the Council Chamber 77 City HTTT the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportun- ity to be heard and did receive evidence and reports, and did thereupon consider the recommendations of the City Planning Com- mission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is pro- posed to change said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. -1- F 5 9 3 6 NOW, THEREFORE, Pf, IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 5634 in Reclassifi- cation proceedings No. F- 59 -60 -36 be, and the same is hereby amended as follows: That the description of the property proposed to be reclassified be amended to read: All that property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: The Southeast 1/4 of the Southeast 1/h of the Southeast 1/4 of Section 11, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a map recorded in Book 51, Page 11 of Miscellaneous Maps, Records of Orange County, California; and that the change of zones, from R-;, RESIDENTIAL-AGRICUL- TURA.LL ZONE to C-1, NE IGH'3ORHOOD -COP fM RCIAL and C -3, HEAVY COMMERCIAL ZONES, provided for in said resolution,be amended as follows: That the southeast corner of the above described pro- perty, 180 feet by 150 feet extending 180 feet north on Stanton Avenue and 150 feet west on Lincoln Avenue be changed to C -3, HEAVY-COMMERCIAL ZONE; and That the remainder of said property be changed to C -1, NEIGHBORHOOD- COP- MERCIAL ZONE; and that said changes be made subject to the following con- ditions: 1. (a) That all engineering requirements of the City of Anaheim along both Stanton and Lincoln Avenues, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurte- nant work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said en- gineering requirements. 2. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 3. That the owners of the property place of record standard City of Anaheim C -1 and C -3 Deed Restric- tions covering the respective areas, approved by the City Attorney, which restrictions shall limit the uses of the C -3 property to a service station or any C -1 uses. I1. That the owners of the property deed to the City of Anaheim a strip of land 55 feet in width, from the center line of the street, along Stanton Avenue for street widening purposes. -2- ATTEST: (SEAL) 5. That the buildings to be constructed on subject property be erected essentially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 6. That all of the above conditions, with the except- ion of Conditions Nos. 1(a) and 5 be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and sub- mit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to r:mend said Anaheim Muni- cipal Code to accomplish the object herein found and deter- mined to be necessary and proper.
