1960-6095WHEREAS, The City of Anaheim and The Atchison, Topeka and Santa Fe Railway Company have mutually agreed that one Standard No. 8 flashing light signal and one 12-foot arm canti- lever type flashing light signal should be installed at the Santa Ana Street crossing of the Santa Fe tract (designated by Public Utilities Commission of the State of California as Crossing No. 2-168.0); and RESOLUTION NO. 6095 A RESOLUTION OF THE CITY 00UNCIL OF THE CITY OF ANAHEIN APPROVING AND AUTHORIZING THE EXE- CUTION OF AN AGRFaiENT i0 BE ivLADE AND ENTERED INTO BY AND BETWEEN THE CITY OF ANAHEYi AND THE ATCHI SON, TOPEKA AND SANTA FE RAILWAY WN?ANY, WITH REFERENCE TO THE INSTALLATION OF FLASHING.LIGHT SIGNALS AT THE SANTA ANA STREET CROSSING OF THE SANTA FE TRACE. WHEREAS, The Atchison, Topeka and Santa Fe Railway Company has submitted to the City of Anaheim an agreement to be made and entered into by and between said Railway Company and the City for the installation of said flashing light signal; which agreement the City Council finds would be for the benefit and best interest of the City and should be approved; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreerent this day submitted to the City Council, to be made and entered into by and between the City of Anaheim and The Atchison, Topeka and Santa Fe Railway Company, for the construction of one Standard No. 8 flashing liuht signal and one 12-foot arm cantilever type flashing light signal at the Santa Ana Street crossing of the Santa Fe track (designated by the Public Utilities Commission of the State of California as Crossing No. 2-168.0), the terms and conditions of which are hereinafter set forth, be and the same is hereby approved. That the terms and conditions of said agreement are as follows: 1. Santa Fe shall do the following work: (a) Install the above-mentioned flashing light signals at Santa Ana Street crossing, removing the existing pro- tection at said crossing. 2. Such work shall be performed as soon as practi- cable, considering availability of materials and manpower, and in consideration thereof the City shall pay to said Railway Company as its share of the cost thereof, one-half of the actual total cost presently estimated by The Atchison, Topeka and Santa Fe Railway Company to be Seven Thousand Two Hundred Forty-four ($7,2L11.00) Dollars. -1- ATTEST: 3. That upon completion of the work specified in Paragraph No. 1 above, said Railway Company shall render City a bill for its portion of the costs and the City shall promptly reimburse said Railway Company for such costs. h. That all work covered by said agreement shall conform to requirements of the Public Utilities Commission of the State of California. That The Atchison, Topeka and Santa Fe Railway Company,at its sole cost and expense, shall maintain and keep in coed repair the afore- mentioned flashing light signals so long as said signals are required at the Santa Ana Street Crossing (No. 2 168.0). 6. The ownership of all materials used or placed in connection with the work specified in Paragraphs 1 and r hereof shall be in The Atchison, Topeka and Santa. Fe Railway Corrmpany. Said Railway Company shall maintain at its sole expense any street paving within the track area of said crossings, and for two feet outside thereof. 8. The City of Anaheim shall maintain at its sole expense any street improvement within said crossing, other than specified to be maintained by said Railway Company in. Paragraph 7 hereof. BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they are hereby authorized to execute said agreement for and on behalf of the City of Anaheim, THE FOREGOING RESOLUTION is approved and signed by me this 21st day of June, 1960.
