1960-6090WHEREAS, the City Planning C mmissi n of the City of Anaheim has heretofor duly pas =.d and adopted a resolution declar- ing its intentio+ to change the boundaries of the zone or zones hereinafter mentio:• ed and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribe +d in Article. IX, Chapt r 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zone nF and did receive evidence and reports from persons inter step. therein; and WHEREAS, withi a period of forty (1.0) days following the final hearing thereon the Planning Clommission did duly announce by formal resolution its finding of f ©ts, -.gad declare: its opinions and reaso:', s for reoomm- :nding an amendment t aid Article IX,. Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundari s of the zne hereinafter mentioned and described; and WHEREAS, upon receipt of th:- report and recommendation of the City Planning Commission th City Council did thereupon fix the Ch day of _,Z r_g_ a 19 c as the time and the Counc amber in the City of th -fifty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the marine nd as provided in said Article. IX, Chapter 2 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons int_.rested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendatio:,s of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said props erty and area in such new zone or zones will increase the value of said property and area and will ot depreciate the values of prop- erty in adjoining zones. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. RESOLUTION NO. 6090 -1- F- Lot J in Block B of Tract No. 13, in the City of Anaheim, County of Orange, State of Calif- ornia, as pe'r map recorded in Book 9, Page 12 of Miscellaneous Maps, in the Office of the County Recorder of said county; be changed from R -A, RESIDENTIAL AGRICULTURAL ZONE to the fol- lowing zones, upon the conditions hereinafter set forth: That the Northwest corner of subject property ex- tending 150 feet South on Brookhurst Street and 125 feet East on Broadway, be changed to C -3, HEAVY COMMERCIAL ZONE; and That the remainder of subject property be changed to C -1, NEIGHBORHOOD-COMMERCIAL ZONE, upon the following conditions: 1. That theijses of the C -3 portion of subject pro- perty be limited to a service station or any C -1 uses. 2. That the owner of subject property deed to the City of Anaheim a strip of land 45 feet in width from the center line of the street along Broadway, and a strip of land 60 feet in width from the center line of the street along Brookhurst Street for street widening purposes. 3. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot along both Brookhurst Street and Broadway for street lighting purposes. (a) That all engineering requirements of the City of Anaheim along Brookhurst Street and Broadway, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City Engi- neer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 5. That landscaping be provided and maintained for a depth of 10 feet along Broadway, and for a depth of 6 feet along Brookhurst Street. L! 6. That a 6 -foot concrete block wall shall be con- structed along the entire easterly property line. 7. That a revised site plan of the proposed development shall be s'ihmitted by the applicant, showing a revis- ed parking layout and fewer entrances than are indi- cated on the present site plan which was submitted to the City Council. 8. That the owner of subject property place of record standard City of Anaheim C -1 and C -3 Deed Restrictions, 01 n, 0i A J^ n ahe 1 -2- covering the respective areas, which restrictions, shall limit the uses of the C -3 property to a service station or any C -1 uses. 9. That all of the above conditions with the except- ion of conditions Nos. 1, 4(a), 5 and 6 be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
