1960-6086RESOLUTION NO. 6086 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE "MAYOR AND CITY CLERIC TO ENTER INTO AN AGREEMENT WITH THE ORANGE COUNTY FLOOD CONTROL DISTRICT FOR THE CONSTRUCTION OF BRIDGES AT AiNIAHEIM ROAD AND LA PALMA AVENUE AS A PART OF THE CARBON CANYON CREEK DIVERSION CHANNEL; AND AUTHORIZING PAYMENT OF THE CITY PERCENTAGES OF THE COSTS OF SAID BRIDGES. WHEREAS, under the authority of the Orange County Flood Control District Act, the Orange County Flood Control District proposes to construct Carbon Canyon Creel: Diversion Channel, which channel is Project E -2 of the Engineer's Report dated March, 1955; and WHEREAS, the construction of Carbon Canyon Creek Diversion Channel, Project E -2, will consist of constructing approximately 5.3 miles of earth channel, one retarding basin and four bridges; and WHEREAS, the obligation of the Orange County Flood Control District in respect to Anaheim Road and La Palma Avenue when constructing said Project L -2 is that of restoring them to their condition of usefulness existing prior to said Dis- trict's construction, and this would constitute the construction of a bridge 26 feet in width at Anaheim Road and a bridge 28 feet in width at La Palma Avenue; and WHEREAS, the City of Anaheim desires that said bridges be constructed to ultimate width, which would constitute a bridge 62 feet in width at Anaheim Road and a bridge 76 feet in wilt; at La Palma Avenue; and WHEREAS, the Orange County Flood Control. District has offered to enter into an agreement with the City of Anaheim for the construction of said bridges in accordance with the desire of the City of Anaheim by a portioning the costs of the construction of said bridges in an equitable manner between the City and said District, and has submitted to the City; a form of agreement to be made and entered into by and between the City and said District for the construction of said bridges, the terms and conditions of which the City Council finds to be fair and reasonable; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement this day submitted to the City Council by the Orange County Flood Control District, to be made and entered into the City and said District for the construction of a bridge 62 feet in width at Anaheim Road and a bridge 76 feet in width at La Palma Avenue, upon the terms and conditions and f cr the percentages of costs herein- after set forth, he and the sag e is heresy approved. That said terms and conditions and percentages of costs are as follows: 1 1. Districtts Flood Control Engineer shall prepare or cause to be prepared, plans and specifications for said bridges and submit same to the City Engineer of Anaheim for checking and approval. 2. Upor approval of said plans and specifications by said City IT 'i hcer, and when r,l Lns and sp ci i icat ions for that portion of Project E -2 within the city limits of Anaheim have been approved by Anaheim in accordance with the applica- ble provision of the Orange County Flood Control Act. District shalt promptly underta1;e and per orm all of the worl or adver- tising for bids and awarding a contract, all in accordance with the provisions of law governing the same. 3. Diring construction of said bridges District shall furnish a resident engineer to perform the usual functions of a resident engineer. During said construction Anaheim may also furnish a resident engineer, and in such case the resident engineers will col -crate and consult with each other, but the orders of the Districtts resident ene ineer shall be final. As hereinafter provided, Anahe i 7 shall pay to District its percentages of the cost of said bridges; said percentages of cost shall be computed on the following basis; (a) The total construction cost shall be the sum of the following; The quantity of each bid item for said brid7o multiplied by the re- spective unit nrice paid the District's con- tractor for said bid items and the cost of relocation of utilities made necessary by the constru.ction of bridges wider than 20-feel and not required by channel work. (b) Anaheim's e 'rce:lta(Je of the Anaheim 'Load bridge shall be n/6=. of the total cost of said bridge plus of this amount to cover Districtts cot of design, inspection, field c=nci.neerin g arc final reports and acceptance. (c) Anaheim's Percentage of the La Palma ,ivenue br i dee shall he W7 or the total cost of said bridge plus 5 of this amount to cover Districtts cost of design, inspection, field engineering and final reports and acceptance. 5. Upon completion of construction and filing notice of completion of same, District shall bill City for City's percentage of the costs. Said bill shall itemize the contract bid items and amounts paid for the respective bid items. City shall pay to District the amount of said bill within 30 days of the receipt thereof. 6. From and after the completion of said construction. the maintenance of the portions of said bridges above the eleva- tion of the bottom of the bridge decks shall be the responsibility of Annhe i and the maintenance of the portions of said bridges below said elevation shall be the responsibility of Gi strict. AND PE. TT FURTHER PY,SOLVED that the Mayor and City Clerk be and tbey are hereby authorized to execute said agree- ment for and on behalf of the City of Anaheim. BE IT FURTHER RESOLVED that the City Auditor he, and he is hereby authorized to pay to the Orarge County Flood Control District the Cityts percentages of the costs of said bridges at the time and in the manner set forth in said agre(ment.
