1960-6016A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE* WHEREAS, the City Planning C «mmission of the City of Anaheim has heretofor.R duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article. IX, Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct such public hearing to consider said proposed change of zone or nee:, and did r naive evidence and reports from persons interested therein and WHEREAS, within a period of forty (.0) day following the final hearing thereon the Planning Commission did duly announce by formal resolution its findings of facts and dcolare its opinions and reasons for recommending an amendment ti said Article IX Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission the City Council did thereupon fix the 1 th day of Ma 19 60 a as the time and the Count Chamber in the ity a of thty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article IX, Chapter 2 of the Anaheim Municipal Cod and WHEREAS, at the time and place fixed for said public hear= ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the z, ne or zones to which it is proposed to change said property and area and that the inclusion of said props erty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: All that certain land situated in the State of California, County of Orange, described as follows: RESOLUTION NO. 6016. el© The West 100 feet of the East 524 feet of the North 288 feet of the Northwest quarter of the Northwest quarter of the North- east quarter of Section 13, Township 1 South, flange 11 West, S. B. B. M. Excepting therefrom the South 36 feet of the North 66 feet; be changed from R-1, ONE-FAMILY RESIDENTIAL ZONE to C-1. NE "OOD- COMMERCIAL ZONE, subject to the following conditions: 1. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City Engineer and in accordance with standard plans and specificatins on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 2. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, for street lighting purposes. 3. That the owners of subject property place of record standard City of Anaheim C-1 Deed Restrictions, approved by the City Attorney, from which shall be omitted Condition No. 2 requiring masonry construc- tion. /1. That all of the above conditions, with the exception of Condition 1(a), shall be complied with within a period of 90 days fromdate hereof, or such further time as the City Council may grant.
