1960-5999RESOLUTION NO. 9° A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE, WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentio:g ed and descri ed and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Article. IX, Chapt -r 2 of the Anaheim Municipal Code, and did duly hold and conduct such public he ring to consider said proposed change of zone or zoniF, and did receive evidence and reports from persons interested th rain and WHEREAS, within a period of forty (1O) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts a, d dealers; its opinions and reasons for recommending an amendment to said Article IX,. Chapter 2 of the Anaheim Municipal Coda to -ffect the proposed changes i the b undari s of the z ns hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 10th day of r Niay 1,960 as the time and the Council hamber in the pity all of thTty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner nd as provided in said Article IX, Chapter 2 of the Anaheim Municipal Code; a WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly h:ld and conduct such public hearing and did give all persons int rested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said propel erty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as followsg to wit F- 59 -60 -91 Beginning at a point on the South line of the West half of the Southeast quarter of the Southeast quarter of Section 15, Township 4 South, Range 11 West, S. B. B. M., 378.5 feet West of the Southeast corner thereof, and running thence West 82.69 feet along the South line of said West half; thence North parallel to the West line of the said West half, 535.72 feet to a point on the Southerly line of the right -of -way of the Pacific Electric Railroad; thence Southeasterly along said right -of -way line, 103.16 feet; thence South, parallel to the West line of the said West half, 473.60 feet to the point of beginning. be changed from R -A, RESIDENTIAL AGRICULTURAL ZONE to 0-1, NEIGH- BORHOOD-COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property deed to the City of Anaheim a strip of land 53 feet in width from the center line of the street, along Ball Road, for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engin- eer; and (b) that a bond in an amount and form satis- factory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 3. That the owners of subject property pay to the City of Anaheim the sum of $2.00 Per front foot for street lighting purposes. 4. That subject property be developed in accordance with the plans presented to the City Council and on file with the City of Anaheim. 5. That an area 10 feet in width, from the property line, along Ball Road be landscaped and said landscaping maintained. 6. That the owners of subject property place of record standard City of Anaheim 0 -1 Deed Restrictions, approved by the City Attorney. 7. That all of the above conditions, with the exception of Conditions No. 2(a), 4 and 5, be complied with within a period cf 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
