1960-5971RESOLUTION NO. 5971 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIN APPROVING AN AGREEMENT TO BE MADE AND ENTERED INTO BY AND BETWEEN THE CITY OF ANAHEIM AND THE COUNTY OF ORANGE FOR THE INSTALLATION OF A TRAFFIC SIGNAL AND INTER- SECTION LIGHTING AT THE INTERSECTION OF BROOKHURST STREET AND CRESCENT AVENUE; AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID AGREEMENT. WHEREAS, considerable traffic congestion presently exists and is progressively increasing at the intersection of Brookhurst Street and Crescent Avenue; and WHEREAS, a study has been completed and the conclusion drawn that traffic conditions at said intersection warrant the installation of traffic control signals and highway intersection lighting for the proper and orderly movement of traffic; and WHEREAS, said intersection is partly within the City of Anaheim and partly in the unincorporated area of the County of Orange; and WHEREAS, the relief of the existing traffic congestion at said intersection requires the cooperation of the County of Orange and the City of Anaheim; and WHEREAS, the County and City desire to enter into an agreement for the construction and installation of a traffic signal and intersection lighting, and associated road work at said intersection, and to specify the proportionate share of the costs that are to be borne by the City and the County and to provide for the maintenance of said traffic signal, as more particularly set forth in the form of agreement prepared by the County of Orange and this day submitted to the City Council; NOW, THEREFORE, BE IT RESOLVEn by the City Council of the City of Anaheim that the agreement this day submitted to the City Council by the County of Orange, to be made and entered into by and between the City of Anaheim and the County of Orange for the construction, installation and maintenance of a traffic signal and intersection lighting system and associated road work at the intersection of Brookhurst Street and Crescent Avenue, upon the terms and conditions and for the proportionate share of the costs set forth in said agreement and as hereinafter set forth, be and the same is hereby approved. That said terms and conditions are as follows: 1. The County of Orange shall: (a) Prepare the detailed plans, specifications and estimate for the project. (b) Prepare map and deed for all necessary additional right of way. -1- (c) Have jurisdiction of the construction area within the City, the same being Brookhurst Street to a point from Crescent Avenue 500 feet northerly and Crescent Avenue to a point from Brookhurst Street 500 feet easterly, during the period of time from commencement of the project until its completion. (d) Be designated as the contracting and con- struction agent for the County and the City to do and perform all acts and things necessary or required in order to construct the project in accordance with the plans and specifications, including material control, inspection of the construction work, and to execute and deliver all documents necessary or required in connection with the construc- tion and completion of said project, including certificate of day labor, equipment and material costs, and certification of comple- tion of the project. 2. The City of Anaheim shall: (a) Approve plans and specifications as to design and construction features affecting the con- struction operation and .maintenance of the portion of the project within the City. (b) Approve map and deed of right of way and make all the necessary arrangements to acquire the right of way for its portion of the project and shall, by appropriate Resolution of the City Council so certify to the County, prior to the adoption of the Resolution of the Board of Supervisors approving the project plans and specifications, that such acquisition has been accomplished. (c) Enter into an agreement with Orange County Flood Control District for extension of proposed Carbon Creek culvert on northeast corner of in- tersection and shall furnish the County with copy of fully executed agreement prior to adoption of Resolution by Board of Supervisors approving the project plans and specifications. (d) At all times during the progress of construction of the project have access to the work for the purpose of inspection thereof and should the City deem any remedial measures to be necessary, it shall notify the Road Commissioner of the County thereof. 3. Upon completion of the project, any and all road work necessary in connection with the project shall be paid for by the respective parties on the basis of the actual work done within the limits of their respective jurisdictions. -2- 4. Upon completion of the project, the Cityts share of the installation of the traffic signal and intersection lighting system shall be determined in the same ratio to the total cost of such system as the number of legs under the City's jurisdiction entering the intersection at the tine the project is advertised for bids. Upon completion of the project, the County shall submit full, true and correct copies of documents, certificates and itemized bills to the City, and the City shall reimburse the County within 30 days upon submission of state- ment of such costs for the full cost of the construction as defined in paragraphs numbered 3 and L hereof. 6. All construction and installation costs shall be based on the contract unit cost. 7. The cost of design, survey, construction engineering and in addition 16% of design, survey and construction engineering labor costs representing the cost of vacation, sick leave and retirement shall be included as a part of the full cost of construction and shall hereinafter be referred to as Engineering Costs. 8. Upon completion of the project, any and all Engineering Costs necessary in connection with the project shall be paid for by the respective parties in the same ratio as the sum of the construction and installation. 9. Funds to be used for the project: (a) The estirrated cost of the project covered by said Agreement is: CONSTRUCTION Road Work $10, Signal Lighting 8,L100.00 ENGINEERING 1 TOTAL $20,550.00 (b) On the basis of the above estimate the project shall be financed as follows: ITEM COST TO CITY COST TO COUNTY 1. CONSTRUCTION a. Road Work 2,190.00 8,170.00 b. Signal Lighting 4,200.00 L,200.00 2. ENGINEERING 610.00 1,180.00 TOTAL 7,000.00 13,550.00 10. After the completion of the project, the traffic signals shall be maintained by the County and the City shall pay to the County upon submission of said costs the maintenance and energy costs in the same ratio to the total cost as the number of legs under the City's jurisdiction entering the intersection are to the total number of legs entering the intersection. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to execute said agreement for and on behalf of the City of Anaheim..
