RESOLUTION NO. 5961
A RESOLUTION OF THE CITY WUNCIL OF THE CITY
OF ANAHEIM PETITIONING THE STATE DEPARTMENT
OF AGR I CULTURE TO ADD CHLOROP I CR IN TO THE
INJURIOUS MATERIALS SECTION OF THE CALIFORNIA
ADMINISTRATIVE CODE.
WHEREAS, the City of Anaheim recognizes the straw-
berry industry to be a.major agricultural industry of Orange
County, and that many of the strawberry growers are farming
within the City Limits of Anaheim; and
WHEREAS, the City of Anaheim recognizes that
chlcropicrin is being used by the strawberry grower as a
soil fumigant and that there have been instances when this
material has not been kept confined to the premises where
applied; and
WHEREAS, this release of gas at nights from
chloropicrin under certain atmospheric conditions has been
a source of annoyance and discomfort to a considerable number
of persons living adjacent to the fields where applied and
has denied them a reasonable use of their property; and
WHEREAS, unless proper regulatory measures are
taken tc prevent the misuse of this material, and unless a
proper county agency is delegated to supervise the use of
chloropicrin, the City of Anaheim will be required to enact
local legislation prohibiting the use of this material in
order to protect the health and general welfare of its
citizens;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the City of Anaheim does petition
the State Department of Agriculture to add the material,
chloropicrin, to the injurious materials section of the
California Administrative Code, and that this material be
applied only under permit and under the supervision of the
Orange County Agricultural Commissioner.
THE FOREGOING RESOLUTION is approved and signed by
me this 2!1st day of April, 1960.
