1960-5920A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City P1 ning Commission .f the City of Anaheim has heretofore duly pass ;d and dopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mexntio:•,ed and described and did fix a time and place for the holds tg of a public hw :ari;,g thereon in the manner and as prescrib -d in Article IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hea=ring to consider said proposed change of zone s zone n, and did recei e evidence and reports from persons inter -st ;d therein; and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of f: cts +d cholera its opinions and reason for recommending an ame dment said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes i•, the b *undariss of th zone hereinafter mentioned and described; and WHEREAS, upon rtoeipt of th r =port and recommendation of the City Planning Commission, th City Council did thereupon fix the t,�h day of i l a 19 60 s the time and the Council C in the sty -ail of thz City of Anaheim as the place for a public hearing upon >aid proposed change of zone, B.A. did give notice thereof in th manner =.nd as provided in said Article IX, Chapter 2 of the Anaheim Munic p =.1 Cody and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold a d conduct such public hearing and did give all person into rested therein an pportunity to be heard and did receive evidence and reports, and did thereupon con- sider the reconmendations of the City Planning Commission; and WHEREAS, the City Council doe find and determine that the property and are proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set'forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop.= arty and area in such ew zone or zones will increase the value of said property and area and will not d pr =ciate the values of prop- erty in adJ`ining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim th =t all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: to wit: RESOLUTION NOe 91C —1— PARCEL 1: The South 96 feet of the North 193 feet of East one -half of the East one -half of the Southeast quarter of the Southeast quarter of Section 14, in Township L South, Range 11 West, San Bernardino Base and J eridian; F- 59 -60 -80 ATTEST: EXCEPTING THEREFRO1v the East G0 feet thereof as conveyed to the State of California by deed recorded Narch 5, 1951, in Book 2153, Page 250, Official Records. PARCEL 2: The East 8 feet of the South 96 feet of the North 193 feet of the West one -half of the East one -half of the Southeast quarter of the Southeast quarter of Section 14, in Township L South, Range 11 West, San Bernardino Base and Meridian. be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE. to C -1 NEIGHBORHOOD- CON�iI ERCIAL ZONE a upon the fo conditions: 1. That a 20 -foot front yard building setback be maintained and that said front yard set back area be landscaped. 2. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and pav- ing, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering require- ments. 3. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 4. That the owners of subject property place of record standard City of Anaheim C -1 Deed Restrictions, approved by the City Attorney. 5. That Conditions Nos. 2(b), 3 and Ii above mentioned be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
