1960-5916RESOLUTION NO. 5916 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL C ODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentio:.:ed and described and did fix a time and place for the holding of a public hearing thereon in the manner and as prescrib -,d in Artiole.IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zone, and did r =ceive evidence and reports from persons intern: sted th- reein; and WHEREAS, within a period of forty (LO) days following the final hearing thereon, the Planning Cc•,mmission did duly announce by formal resolution its findings of facts and dcclex its opinions and reaso.+,s for recommending an amens:; =4.ent tO said Article IX Chapter 2 of the Anaheim Municipal Cod y. to effect the proposed changes in the boundaries of the zon hereinafter mentioned and described; and WHEREAS, upon r ceipt of th r -port and recommendation of the City Planning Commission, the City Council did thereupon fix the th day of April a 19 60 as the time and the Council hambe in the City T f thirty of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner nd as provided in said Article IX, Chapter 2 of the Anaheim Municipal Cod and WHEREAS, at the time and place fixed for said public hear- ing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an pportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendation of the City P1anni g Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that th inclusion of said prop erty and area in such new zone or zone will increase the value of said property and area and will not depreciate the values of prop=- erty in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as followsg to wit: -1- That portion of Lot 39 of Anaheim Extension, in the County of Orange, State of California, as shown on a map made by William Hamel filed in Book 3, Page 163, Records of Los Angeles County, California, described as follows: F- 59 -81 be changed from R -O, ONE-FAMILY SUBURBAN ZONE to C -1, NEIGHBOR- HOOD COMMERCIAL ZONE, upon the following conditions: ATTEST: Commencing at the Northwest corner of Lot 39 of Anaheim Extension, said Northwest corner being the intersection of the center line of La Palma Avenue, with the center line of West Street, thence Easterly along the North line of said Lot 39, a distance of 1469.5 feet to the true point of beginning, thence South. 15 23 50" East a distance of 110.28 feet, thence North 72 41' 37" East a distance of 100.06 feet, thence North i5e 23' 50" ;^est to the North line of said Lot 39, thence Westerly along the North line of said Lot 39 to the true point of beginning. EXCEPTING THEREFROM the Northerly 50.00 feet as measured at right angles from the North line of said Lot 39. 1. That the owners of subject property pay to the City of Anaheim the sure; of $2.00 per front foot for street lighting purposes. 2. That subject property be developed in accordance with the plans this day presented to the City Council and on file with the City of Anaheim. 3. That the owners of subject property place of record standard City of Anaheim C -1 deed re- strictions, approved by the City Attorney, which restrictions shall limit the use of the property to business and professional offices only. That conditions Nos. 1 and 3 above- .mentioned be complied with within a period of 90 days fro.xr date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said. Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
