A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE GRANTING OF A
RIGHT OF ENTRY TO ORANGE COUNTY FLOOD CONTROL
DISTRICT TO ENTER UPON CERTAIN PROPERTY OF
THE CITY OF ANAHEIM WHICH LIES WITHIN THE
PROPOSED RIGHT OF WAY OF THE CARBON CREEK
DIVERSION CHANNEL AND AUTHORIZING THE EXEC-
UTION OF SAID RIGHT OF 'ENTRY.
WHEREAS, the City of Anaheim owns certain land which
lies within the proposed right of way for the Carbon Creek
Diversion Channel which the Orange County Flood Control District
desires to purchase and for which negotiations are now in prog-
ress; and
WHEREAS, in order that construction of the Channel
may commence on November 1st, 1960, as scheduled, the Orange
County Flood Control District has requested that the City
grant to it a Right of Entry over said land pending completion
of negotiations for fee rights; and
WHEREAS, the Orange County Flood Control District
has submitted to the City a Right of Entry Agreement to be
made and entered into by the City of Anaheim as Grantor and
the Orange County Flood Control District wherein the City
grants to said District the right to enter upon the property
of the City as shown shaded in red on the copy of the Orange
County Flood Control District Right of Way Map No. E2 -2 at-
tached to said Right of Entry Agreement and made a part there-
of, the terms and conditions of which Right of Entry Agreement
the City Council finds to be satisfactory;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the Right of Entry Agreement this
day submitted to the City Council by the Orange County Flood
Control District be and the same is hereby approved, and that
the City of Anaheim grant to the Orange County Flood Control
District, its officers, employees, agents and invitees the
right to enter upon the property of the City as shown shaded
in red on the copy of the Orange County Flood Control District
Right of Way Map No. E2 -2 which is attached to said Right of
Entry Agreement,upon the terms and conditions set forth in
said agreement.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be and they are hereby authorized to execute said agree-
ment for and on behalf of the City of Anaheim.
