1960-6399RESOLUTION NO, 6399 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ing No. F- 60 -61 -35 to consider an amendment to Title 18 of the Anaheim Municipal Code relating.to zoning and to con- sider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix"the's_18th day of October 19 60 as the time, and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the in- corporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following described property: -1- F- 60 -61 -35 That portion of lot 6 of the Miles Rancho, as shown on a Map recorded in Book 4, page 7 of Miscellaneous Maps, records of Orange County, Calif.,described as follows: Beginning at the Southeast corner of Tract 2302, as shown on a Map recorded in Book 76, pages 29 to 31, inclusive, of Miscellaneous Maps, records of Orange County, Calif.; thence North 0° 20' 20" West 252.00 feet along the East- erly line of said Tract 2302, to the Southwest corner of land described in a deed to C. R. Young and Sons, filed April 22, 1949, as Document No. 17859, in the Office of the Registrar of Titles of Orange County, Calif.; thence North 89 39 40" East 150.00 feet along the Southerly line of said land of C. R. Young, and Sons, to the Westerly line of Spadra Road, as shown on said Map of Tract No. 2302; thence South 0° 20' 20" East 252.00 feet along said Westerly line to the center line of Romneya Drive, as shown on said map of Tract 2302; thence South 89° 391 40" West 150.00 feet to the point of beginning; be excluded from the C -2, GENERAL COMMERCIAL ZONE, and incorporated in the following zone or zones: C -3, HEAVY COMMERCIAL ZONE, upon the conditions hereinafter set forth: 1. That the owner of subject property deed to the City of Anaheim a strip of land 45 feet in width from the center line of the street, along Harbor Boulevard, and a strip of land 32 feet in width, from the center line of the street, along Romneya Drive, for street widening purposes. 2. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 3. (a) That sidewalks be installed along Harbor Boule- vard and Romneya Drive as required by the City En- gineer, and in accordance with plans and specifica- tions on file in the Office of the City Engineer; and (b) That a bond in an amount and form satisfac- tory to the City of Anaheim be posted with the City to guarantee the installation of said sidewalks. 4. That a separate application be filed for the free- standing sign or signs shown upon the plans or drawings. -2- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper. 5. That the owner of subject property place of record standard City of Anaheim C -3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of the property to a service station and new or used car lot, and any C -2 uses. 6. That Conditions Nos. 1, 2, 3(b) and 5, above -men- tioned, be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant.
