1960-6398RESOLUTION NO. 6398 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING SPECIAL USE PERMIT NO. 83 TO VETERANS OF FOREIGN WARS, ANAHEIM POST NO. 3173, TO CONSTRUCT AND OPERATE A MEETING HALL ON THE PROPERTY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from Anaheim Post No. 3173, Veterans of Foreign Wars, 106 North Philadelphia Street, Anaheim, California, for a Special Use Permit to construct and operate a meeting hall with bar facilities on the following described property situated in the City of Anaheim, County of Orange, State of California: That portion of Vineyard Lot B1, as shown on a map recorded in Book 4, Pages 629 and 630 of Deeds, Records of Los Angeles County, California, described as follows: Beginning at the Southwesterly corner of said Vineyard Lot B1; thence Northerly 404.05 feet along the Westerly line of said Vineyard Lot Bi to the Southerly line of the Northerly 10 acres of said Vineyard Lot Bi; thence Easterly 100.00 feet parallel with the Northerly line of said Vineyard Lot B1; thence Southerly 404.12 feet parallel with said Westerly line to the Southerly line of said Vineyard Lot B1; thence Westerly 100.00 feet along the Southerly line to the point of beginning; EXCEPT the Southerly 7.00 feet thereof, as con- veyed to the City of Anaheim for widening Sycamore Street. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on September 19, 1960, notice of which said public hearing was duly given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 76 Series 1960 -61, granting Special Use Permit No. 83, subject to certain conditions set forth therein; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said Special Use Permit and did thereupon fix the 18th day of October, 1960 as the time and the Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said Special Use Permit, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consi- deration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that said Special Use Permit should be granted upon the terms and condi- tions hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting Special Use Permit No. 83 be, and the same is hereby sustained, and that Special Use Permit No. 83 be, and the same is hereby granted to Anaheim Post No. 3173, Veterans of Foreign Wars, 106 North Philadelphia Street, Anaheim, California, to construct and operate a meeting hall with bar facilities on the property hereinabove described, subject to the following conditions: 1. (a) That all engineering requirements of the City of Anaheim along the alley on the east side of subject property and on Sycamore Street, such as curbs and gutters, sidewalks, street grading and paving, including removal and reconstruction of existing improvements on Sycamore Street, drainage facilities, or other appurtenant work, be complied with as required by the City Engineer and in accordance with plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 2. That the owner of said property deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Sycamore Street, for street widening purposes. 3. That the irrigation line now located on said property be relocated and protected in conformance with the specifications of the Anaheim Union Water Company and City of Anaheim. 4. That Conditions Nos. 1(b) and 2 above mentioned, be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Special Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
