1960-6374RESOLUTION NO. 6374 A RESOLUTION OF THE CITY 00UNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL ODDE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and con- ducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and re- ports from persons interested therein; and WHEREAS, within a period of forty (40) days follow- ing the hearing thereon, the Planning Commission did duly an- nounce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said pro- posed change in the boundaries of the zone or zones herein- after mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission, the City Council did fix the llth day of October, 1960, as the time, and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said proper- ty, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones herein- after set forth; and did give notice thereof in the manner and form as provided in said Title 1e of said Anaheim Munici- pal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its re- port of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim_ Municipal Code be, and the sane is hereby amended, and that the follow- ing described property: That portion of Lot 5 of block 17 of a subdivision of the South half of Section 21, Township 4 South, Range 10 West, S. B. B. M., as shown on a map recorded in -1- F- 60 -61 -22 Book 1, page 33 of Miscellaneous Maps, records of Orange County, California, a portion of said Lot 5 being shown on a map of Tract No. 2177, recorded in Book 59, pages 36 and 37 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the Northwest corner of the Southerly 260.00 feet of said Lot 5; thence South 89° 41' 50" East 255.01 feet parallel with the Southerly line of said Lot 5 to a line parallel with and distant East- erly 255.00 feet, measured at right angles, from the Westerly line of said Lot 5; thence North 0° 55 00" East 102.26 feet along said parallel line to the Southerly line of Lot 21 of said Tract No. 2177; thence North 89° 33' 43" West 255.01 feet along said Southerly line and its Westerly prolongation to the Westerly line of said Lot 5; thence South 0 55' 00" West 102.85 feet to the point of beginning; be excluded from the C -1, NEIGHBORHOOD- OOMMERCIAL ZONE, and incorporated in the C -2, GENERAL COMMERCIAL ZONE, upon the conditions hereinafter set forth: 1. That the owners of the property deed to the City of Anaheim a strip of land 53 feet in width from the center line of the street, along Euclid Avenue, for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. 3. That the buildings to be erected on subject property be constructed substantially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 4. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 5. That the owners of subject property place of record standard City of Anaheim C -2 Deed Restrictions, ap- proved by the City Attorney, which restrictions shall limit the uses of subject property to one res- taurant with a cocktail bar, and any C -1 uses, the restaurant with cocktail bar to be located 45 feet from the west property line and 5 feet from the north property line and to extend approximately 80 feet east and 40 feet south. -2- ATTEST: 6. That Conditions Nos. 1, 2 (b), L. and 5, above mentioned, be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
