A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EX-
ECUTION OF "UTILITY RELOCATION AGREEhENT NO.
UA 31 -E1" FOR THE RELOCATION OF CERTAIN FACIL-
ITIES OWNED BY THE CITY TO AVOID INTERFERENCE
WITH THE FLOOD CONTROL CHANNEL.
WHEREAS, the Board of Supervisors of the Orange County
Flood Control District has authorized the preparation of plans
and specifications for the construction of Carbon Creek Channel
from the Pacific Electric Railway to the Santa Ana Freeway,
Bond Project B1 Part II, which plans and specifications have
been approved by the City of Anaheim; and
WHEREAS, the City of Anaheim owns certain water trans-
mission pipeline and electric power pole facilities which will
require relocation in order to avoid interference with the pro-
posed channel; and
WHEREAS, it is considered in the best interests of the
City and said Orange County Flood Control District to cause the
necessary relocations to be made prior to the award of a contract
for the channel construction; and
WHEREAS, the Orange County Flood Control District has
submitted to the City of Anaheim an agreement entitled "Utility
Relocation Agreement No. UA 31 -B1" to be made and entered into
by the City and said District, providing for the relocation of
the facilities of the City which will require relocation in order
to avoid interference with said proposed channel, by the City
either with its own force or its emp'~yed contractor, and pr.cvid-
ing for payment of the cost of said relocation work by the Orange
County Flood Control District, the terns and conditions of which
agreement the City Council finds to be fair and reasonable;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the agreement this day submitted to the City
Council by the Orange County Flood Control District entitled
"Utility Relocation Agreement No. UA 31 -B1," to be made and enter-
ed into by and between the City of Anaheim and the Orange County
Flood Control District, providing for the relocation of certain
facilities owned by the City in order to avoid interference with
the proposed flood control channel, said relocation work to be done
by the City either with its own force or its employed contractor
and to be paid for by the Orange County Flood Control District upon
the terms and conditions set forth in said agreement, be and the
same is hereby approved;
BE IT FURTHER RESOLVED that the Mayor and City Clerk be
and they are hereby authorized to execute said agreement for and
on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 11th day of October, 1960.
