1960-6300RESOLUTION NO. 6300. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1273. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition from LOUIS LARAMORE and WILBUR CLARK, owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of the Southwest quarter of the Northwest quarter of the Southeast quarter of Section 22, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the State of California, County of Orange, described as follows: Beginning at a point in the West line of the Southwest quarter of the Northwest quarter of the Southeast quarter of said Section 22, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, said point being located 804.26 feet South 0 14' 30" East from the center of said Section 22, said center point being the intersec- tion of the center line of Cerritos Avenue from the West with the North and South quarter section line of said Section 22; running thence North 89 55' 30" East 660.77 feet to a point in the East line of the Southwest quarter of the Northwest quarter of the Southeast quarter of said Section 22, which point is 165.00 feet South 0° 14' 45" East from a one -inch iron pipe as shown on a Licensed Surveyors Map filed in Book 15, Page 4 of Record of Surveys, in the office of the County Recorder of said Orange County; thence South 0 14' 45" East 85.00 feet along the East line of the Southwest quarter of the Northwest quarter of the Southeast quarter of said Section 22; thence South 89 55' 30" West to a point in the said West line of the Southwest quarter of the Northwest quarter of the Southeast quarter of Section 22; thence North 0 14' 30" West 85.00 feet to the point of beginning. AND WHEREAS, the public hearing at the City said petition on August 15, hearing were duly given as of Title 18, Chapter 18.76 City Planning Commission did hold a Hall in the City of Anaheim upon 1960, notices of which said public required by law and the provisions of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 43, Series 1960 -61, recommending that Variance No. 1273 be granted upon the conditions stated in said resolution; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 20th day of September, 1960, at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the pre- servation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted to LOUIS LARAMORE and WILBUR CLARK, 1111 Beverly Boulevard, Whittier, California, permitting the construction of a restaurant and motel /hotel on the property hereinabove described, subject to the following conditions: -2- The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. NOES: COUNCILMEN: None. ABSENT: COUNCILMEN: None. AND I FURTHER CERTIFY that the Mayor of the City of Anaheim approved and signed said resolution on the 20th day of September, 1960. That the property be developed substantially in accordance with the revised plans presented to the City Council and on file with the City of Anaheim. 2. That the building shall be set back a distance of 50 feet from the planned highway right of way line. 3. That an area 20 feet in width along the front property line, with the exception of access drives and walks, shall be landscaped and said landscaping maintained. DENE M.
