1960-6288RESOLUTION NO, 6288 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED, WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ing No. F- 60 -61 -12 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to con- sider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did affix the 13th day of September 19 60 as the time, and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the in- corporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon con- sider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same Is hereby amended, and that the following described property: F- 60 -61 -12 The East 112 feet of the East 4 acres of the North 10 acres of the East 13 acres of the North 18 acres of the East 30 acres of the Northeast quarter of the Northwest quarter of Section 13, Township 4. South, Range 11 West, S.B.B. M. Excepting therefrom the Southerly 296 feet. Also excepting therefrom the North 66 feet. Also excepting therefrom that portion described as follows: Beginning at a point in the South line of the North 66 feet previously excepted above distant Westerly along said line, 60 feet from the East line of said Northwest quarter; thence Easterly along said South line to said East line; thence Southerly along said East line to a line which is parallel with and Southerly 20 feet, measured at right angles from said South line; thence Westerly along said parallel line 40 feet; thence Northwesterly in a direct line to the point of beginning. be excluded from the R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in the following zone or zones: C 1, NEIGHBOR- HOOD COMMERCIAL ZONE, upon the conditions hereinafter set forth: 1. That all buildings erected on subject property shall be constructed substantially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 2. That the owner of subject property deed to the City of Anaheim a strip of land 45 feet in width from the center line of the street, along Dale Avenue for street widen- ing purposes. 3. (a) That all engineering requirements of the City of Anaheim, along Dale and Lincoln Avenues, such as curbs and gutters, sidewalks, street grading and paving, drainage facilitis, or other appurtenant work be com- plied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the in- stallation of said engineering requirements. 4. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot along both Dale and Lincoln Avenues, for street lighting purposes. 5. That Conditions Nos. 2, 3(b) and 4 above mentioned, be complied with within a period of 90 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
