1960-6210RESOLUTION NO, 6210 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY AND THAT ARTICLE IX CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE, WHEREAS the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public heari:p:g thereon in the manner and as prescribed in Article IX Chapter 2 of the Anaheim Municipal Code and did duly hold and conduct such public hearing to consider said proposed change of zone or zones and did receive evidence and reports from persons interested therein; and WHEREAS withi:s a period of forty (10) days following the final hearing thereon the Planning Commission did duly announce by formal resolution its findings of facts and de «lare its opinions and reasons for recommending an amendment t said Article IX Chapter 2 of the Anaheim Municipal Code to effet the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS upon receipt of the report and recommendation of the City Planning Commission the City Council did thereupon fix the 26th day of Ull 19 60 as the time and the Council Chamber in the City a 1 of the qty of Anaheim as the place for a public hearing upon said proposed change of zone and did give notice thereof in the manner and as provided in said Article. IX Chapter 2 of the Anaheim Municipal Code; and WHEREAS at the time and place fixed for said public hear= ing the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon con- sider the recommendations of the City Planning Commission and WHEREAS the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone as hereinafter set forth is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop= erty and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones, NOW THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim County of Orange State of California described as follows: to wit: -1- F-59-60-115 All that certain land sit in tho State of California, County of Orange, Rancho Las Bolsas, in the City of Anaheim, described as follows: The South half of the Southwest quarter of the Southeast quarter of Section 27, Township 4 South, Range 10 West, S.B.B.&M. EXCEPTING THEREFROM the water well, as reserved in the deed from W. H. Girton and Ruth H. Girton, husband and wife, to Sam Domino and LaVita Domino, husband and wife, as joint tenants, recorded July 6, 1959 in book 4706, page 9h of Official Records. be changed from R-A, RESIDENTIAL-AGRICULTURAL ZONE to C-2, GENERAL-COMMERCIAL ZONE, upon the following conditions: 1. That subject property be developed sub- stantially in accordance with the plans presented to the City Council and on file with the City of Anaheim. 2. That the owner of subject property deed to the City of Anaheim a strip of land 60 feet in width, from the center line of the street, along Harbor Doulevard, and a strip of land 53 feet in width, from the center linc of the street, along Chapman Avenue, for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim along Harbor Boulevard and Chapman Avenue, such as curbs and gutters, sidewalks, street grading and paving, drain- age facilities, or other appurtenant work be complied with as required by the City En- gineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engin- eering requirements. 4. That the owner of subject property pay to the City of Anaheim the sum of 2.00 per front foot along Harbor Boulevard and Chapman Avenue for street lighting purposes. 5. That provision be made to drain that parcel of subject property contiguous to Chapman Avenue, on Chapman Avenue east of Harbor Boulevard. 6. That Conditions Nos. 2, 3(b) and L above- mentioned be complied with within a period of 90 days from date hereof or such further time as the City Council may grant. -2- DE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authop'zed and directed to prepare and submit to the City Council an imendment to Article IX, Chapter 2 of the Anaheim Municipal ,,ode to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be neces- sary and proper.
