1960-6208RESOLUTION NO. 6206 A RESOLUTION OF THE CITY COUNCIL OF THE CITY CF ANAHEIM DENYING VARIANCE NO. 1246 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Mrs. Gertrude Howell, owner of certain real property situ- ated in the City of Anaheim, County of Orange, State of California, described as follows: Lot 22, Tract No. 1421, in City of Anaheim, as shown on a Map thereof recorded in Book 62, Pages 13, 14, 15 and 16, Miscel- laneous Maps, records of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on June 6, 1960, notices of which said public hearing were duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due in- spection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 267 Series 1959-60, denying Variance No. 1246; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying said variance, and said appeal was set for public hearing on June 28, 1960, at 7:00 otcloch. P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Section 9200.17 of the Anaheim Municipal Code; and. WHEREAS, after due investigation and consideration of all evidence and reports offered at said hearing, the City Council did find and determine that said application for a zoning variance permitting the operation of business and pro- fessional offices in the home located on the above described property should be denied, and did thereupon adopt Resolution No. 6106 sustaining the action of the City Planning Commission and denying Variance No. 1246; and WHEREAS, thereafter, to wit, on July 5, 1960, a request was made by Mrs. Gertrude Howell, owner of the here- inabove described property for reconsideration of said applica- tion for Variance No. 1246, and the City Council did hold a public hearing on August 9, 1960, to review said application for a zoning variance and to consider additional information and facts in connection therewith; and WHEREAS, at the time and place fixed for said public hearing to review said application for Variance No. 1246, the City Council did give all persons interested therein an oppor- tunity to be heard and receive evidence and reports; and -1- WHEREAS, the City Council does find that 1. There is no substantial property right pos- sessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the previous ruling of the City Council be upheld and that V:ar iancc No. 1246 permi t t. inrj the operation of business and professional offices in the home located on the property hereinabove described, be, and the same is hereby denied.
