1960-6183RESOLUTION NO. 6133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY or ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS 07 THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM' MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE 07 ZONE. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution declaring its intention to change the boundaries of the zone or zones hereinafter mentioned and described and did fix a time and place for the holding of a public hearingthereon in the manner and as prescirbed in Article IX, Chapter 2 of the Anaheim Municipal Code, and did 4.uly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein; and WHEREAS, within a period of forty (L0) days following the final hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reason for recommending an amendment to said Article IX, Chapter 2 of the Anaheim Municipal Code to effect the proposed changes in the boundaries of the zone hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 2d day of Auaµst 19 60 as the time and the Wesley Methodist Church, 630 North Los Angeles Street in the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Article I1, Chapter 2 of the Anaheim Municipal Code and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons in— terested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said property and area in such new zone or zones will increase the value of said property and area and will not depreciate the values of property in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated inthe City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of the East 100 acres of the Southeast quarter of Section 5, Township 4 South, Range 10 West, in the City of Anaheim, County of Orange, State of California, in the Rancho Los Coyotes, as shown on a map recorded in book 51, page 10, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the Southeast corner of said Section 5, and running thence North 12 chains; thence West 25 chains; thence South 12 chains, and thence East 25 chains to the point of beginning, and being the South 30 acres of the East 100 acres of said Section 5; EXCEPTING THEREFROM the following: Beginning at the Southeast corner of said Section 5; and running thence North 183.5 feet; thence West 1650 feet; thence South 183.5 feet; and thence East 1650 feet to the point of beginning, and being the South 183.5 feet of the East 100 acres of the Southeast quarter of said Section 5. -1- F- 6O -61 -2 be changed from R -A, RESIDENTIAL- AGRICULTUiAL ZONE to R -3. MULTIPLE -FAILY RESIDENTIAL and C -1, NEIGHBORHOOD- COMMERCIAL ZONES, upon the following conditions: 1. That the final map of Tract No. 3812 be recorded in the Office of the County Recorder of Orange County, California, or A. That the owners of subject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Avenue for street widening purposes. B. (1) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. C. That the owners of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. 2. That the owners of the R -3 portion of subject property pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said sum to be paid at the time the building permit is issued. 3. That the setback line shall be at the 72 foot width on the cul -de -sac streets. BR IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper. day of August 191a_. 4. That Condition No. 1 or Conditions A, B, and C, above mentioned be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant.
