1960-6563RESOLUTION NO. 6563 Auditor A RESOLUTION OF THE CITY WUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE JOINT PAYMENT TO THE STATE OF CALIFORNIA BY. THE CITY OF ANAHEIM AND THE CITY OF FULLERTON OF THE MAINTENANCE OOSTS OF. CERTAIN EXISTING TRAFFIC SIGNALS ON ORANGETHORPE.AVENUE; AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH THE CITY OF FULLERTON FOR THE JOINT PAYMENT OF SLID COSTS.. WHEREAS, traffic signals are now in existence at the intersections of Orangethorpe and Harvard (Lemon), Orangethorpe and Raymond (East), and Orangethorpe and Cypress, the expense of the maintenance of which has heretofore been borne by the State of California; and WHEREAS, the State of California is in the process of abandoning Orangethorpe Avenue east of Harbor Boulevard as a State Highway, which will result in the expense for the mainten- ance of said traffic signals to be visited upon the City or Cities in which said traffic signals are located; and WHEREAS, the State has agreed to continue to maintain said signals indefinitely, the expense of said maintenance to be divided between the City of Fullerton and the City of Anaheim for the reason that the intersections heretofore mentioned are common to said two Cities; and WHEREAS, the City of Anaheim and the City of Fullerton desire to enter into an agreement for the joint payment of the expense of said maintenance by the State, and for the joint main- tenance of said signals if at some future date the State of Calif- ornia should discontinue said maintenance; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that an agreement be made and entered into by and between the City of Anaheim and the City of Fullerton for the joint payment to the State of California of the expense of the maintenance of the traffic signals now in existence at the intersections hereinabove mentioned, and for the joint mainten- ance of said signals if at some future date the State should dis- continue said maintenance, the terms and conditions of which agreement shall be as follows: 1. So long as the State of California continues to main- tain the traffic signals heretofore described, said maintenance cost including but not limited to labor, equipment rental, materials and extraordinary items of maintenance, the State will annually submit to the City of Fullerton, a cost breakdown of that which is due the State for said maintenance. 2. The City of Fullerton shall upon the receipt of the claim from the State submit said claim to the City of Anaheim including the cost breakdown as submitted by the State and the expense for the maintenance of said traffic signals shall be borne between the two Cities as follows: -1- In the event that the contingency mentioned in par- agraph no. 3 hereof shall come into existence, the cost for the maintenance of said signals shall be borne as provided in paragraph no. 2 hereof. BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized to execute said agree- ment for and on behalf of the City of Anaheim. THE FOREGOING RESOLUTION is approved and signed by me this 27th day of December, 1960. ATT ST: INTERSECTION FULLERTON ANAHEIM Orangethorpe Harvard (Lemon) 50% 50% Orangethorpe Raymond (East) 50% 50% Orangethorpe Cypress 75% 25% That share of the money which is due from the City of Anaheim shall be paid by the City of Anaheim to the City of Fullerton and the City of Fullerton shall re- mit that sum which is due to the State along with the share which the City of Fullerton is required to pay as indicated above. 3. If at some future time the State of California shall discontinue the maintenance of said signals, the City of Fullerton shall perform the necessary maintenance thereafter in order to maintain said facilities in a safe and usable condition and the methods of mainten- ance employed and adopted by the City of Fullerton shall be subject to the approval of the City of Anaheim.
