1960-6542RESOLUTION NO. 6542 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEINI FINDING AND PASSING UPON ALL OBJECTIONS AND PROTESTS OF PROPERTY OWNERS TO THE REQUIRED CONSTRUCTION OF SIDEWALKS OR CURBS OR BOTH UNDER SECTION 5878.1 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. Public Works WHEREAS, heretofore, to wit, on the 29th day of November, 1960, the City Council did adopt Resolution No. 6491 instructing the Superintendent of Streets to post certain property, notifying the owners thereof to construct curbs and sidewalks upon and along certain streets where sidewalks or curbs, or both, for a total frontage of fifty-per cent or more on one side of the street, have already been constructed, and naming the owners of the parcels of property affected, and containing a description of said parcels; and= WHEREAS, the 13th day of December, 1960, at the hour of 7 :00 o'clock P.M., in the Council Chamber in the City Hall was thereby fixed as day, hour and place when the City Council would hear and pass upon objections or protests, if any, which might be raised by any property owner or other interested persons to the construction and installation of said curbs and sidewalks; and WHEREAS, the City Council did hold and conduct said hearing on the 13th day of December, 1960, at the hour of 7 :00 o'clock P.M., in the Council Chamber in the City Hall, for the purpose of hearing and passing upon all objections or protests to the construction of said curbs and sidewalks and that at said time and place one person appeared in opPos ition to the proposed construction and installation of said curbs and side- walks on the ground that the entire tract should be considered for the installation of said curbs and sidewalks; and WHEREAS, the City Council did consider the objection and did consider all of the factors involved in the proposal. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does find and determine that the objection or protest should be overruled and that the construction of said curbs and sidewalks should proceed. AND BE IT FURTHER RESOLVEDthat if construction of said curbs and sidewalks as specified in the notice given by the Superintendent of Streets is not comuienced within sixty (60) days after the giving of said notice and diligently and without interruption prosecuted to completion, that the Superintendent of Streets shall cause the construction to be done and the cost of same shall be a lien on the property of the respective owners where said sidewalks and curbs are constructed.
