A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEDI LUNI CIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. `vHEREAS, the City Planning Commission of the City of Anaheim did heretofore fix a time and place for the holding of a public hearing upon a proposed change in the boundaries of the zone or zones hereinafter mentioned and described in the manner and as prescribed in Title 18 of the Anaheim vvunicipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein; and WHEREAS, the City Planning Commission having failed to achieve a majority vote of its members within a period of forty (40) days following the final hearing thereon, did refer the matter of said proposed change of zone or zones to the City Council without recommendation; and WHEREAS, upon receipt of the report of the City Plan- ning Commission, the City Council did thereupon fix the 15th day of November, 1960, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Lunicipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports; and AHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim PN Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 13 of the Anaheim TIunicipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: The North 8.13 acres of the Northwest quarter of the Southeast quarter of the Southeast quarter of Section 11, Township 4 South, Range 11 West, San Bernardino Base and i EXCEPTING THEREFROM''_ the Southerly one acre thereof. F- 60 -61 -19 be changed from R -A, RESIDENTIAL-AGRICULTURAL ZONE, to R -3, NULTIPLE -FA ILY RESIDENTIAL ZONE, upon following condi- tions: 1. That subject property be developed substantially in accordance with the plans presented to the City Council, on file with the City of Anaheim and by reference made a part hereof, which plans provide for one -story construction. 2. That a subdivision map of subject property be re- corded in the Office of the County Recorder of Orange County, California, or (a) That the owner of subject property deed to the City of Anaheim a strip of land 32 feet in width from the center line of the street, along Grand Avenue, for street widening purposes. (b) That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot for street lighting purposes. (c -1) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drain- age facilities, or other appurtenant work be complied with as required by the City Engin- eer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (c -2) that a bond in an amount and form:. satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering require ments. 3. That the owner of subject property pay to the City of Anaheim the sum. of $25.00 per dwelling unit, to be used for park and recreation purposes, said sum to be paid at the time the building permit is issued. 1 That Condition No. 2 or Conditions (a), (b) and (c -2), above-mentioned, be complied with within a period of 130 days from date hereof, or such further time as the City Council may grant. EE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 10 of the Anaheim I-unicipal Code to accomplish the objects herein found and de- terrined to be necessary and proper.
