1960-6457RESOLUTION NO° 6457 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its. findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 31st day of May 1960, as the time, and the City o� uncil Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: F -59 -60 -101 That portion of Lot 16 of Anaheim Extension, as shown on a map by William Hamel and filed for record in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the center line intersection of Placentia Avenue 60.00 feet in width and Vermont Avenue 66.00 feet in width, said point also being the Southeasterly corner of said Lot 16; thence from said point of be- ginning and along the center line of Vermont Avenue and the Southerly line of said Lot 16, South 74 34' 15" West 641.43 feet, more or less, to the Westerly line of the land conveyed to Bernard Schroeder by deed re- corded in Book 352, Page 266, Deeds, Records of said Orange County; thence along the Westerly line of the land of Schroeder, North 15 27' 20" West 255.83 feet; thence entering the land of Schroeder, North 74 34' 15" East 712.57 feet, more or less, to the Easterly line of said Lot 16, and the center line of Placentia Avenue; thence along the Easterly line of said Lot 16, and the center line of Placentia Avenue, South 0 05' 15" West 265.51 feet, more or less, to the point of beginning. EXCEPTING THEREFROM the Southwesterly 340 feet thereof. ALSO EXCEPTING THEREFROM the Southerly 135.00 feet of the Easterly 135.00 feet measured along the Easterly and Southerly lines respectively of Lot 16 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of Survey made by William Hamel and filed in the office of the County Recorder of Los Angeles County, a copy of which is shown in Book 3, Pages 163 et seq entitled 'Los Angeles County Maps" in the Office of the County Recorder of said Orange County, for the purpose of this description, the side line of the streets are construed to be the lot lines. Said land is included within the area shown on a map filed in Book 15, Page 499 of Record of Survey in the office of the County Recorder of said Orange County. be changed from the R -3, MULTIPLE- FAMILY RESIDENTIAL and R -1, ONE- FAMILY RESIDENTIAL ZONES to C -1, NEIGHBORHOOD COMMERCIAL ZONE upon the conditions hereinafter set forth: 1. That the owner of subject property deed to the City of Anaheim a strip of land 53 feet in width from the center line of the street, along Placentia Avenue for street widening purposes. 2. ghat sidewalks be installed along Placentia Avenue as required by the City Engineer, and in accordance with standard plans and specifications on file in the office of the City Engineer. -2- 3. (a) That all engineering requirements of the City of Anaheim, along Vermont Avenue, such as curbs and gutters, sidewalks, street grading and paving, drain- age facilities, or other appurtenant work be complied with as required by the City Engineer and in accord- ance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements and the installation of the sidewalks along Placentia Avenue as required in Condition No. 2 hereof. L.. That the owner of subject property pay to the City of Anaheim the sum of $2.00 per front foot along Vermont and Placentia Avenues for street lighting purposes. 5. That there shall be no access to subject property on Tyrol Place. 6. That an alley access be let and an easement agreement be made by Mr. Huarte granting an easement for the flow of trucks through subject property. 7. That Conditions Nos. 1, 3(b), 4 and 6, above mentioned, be complied with within a period of ninety (90) days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
