All that certain real property situated in the
County of Orange, State of California, to wit:
PARCEL 1:
A strip of land 20 feet in width over, under and
across a portion of Lot 4 as shown on a map thereof,
recorded in Book 1, Page 20 of Records of Survey in
the Office of the Recorder of Orange County, Cali-
fornia, lying 10 feet on each side of the following
described centerline:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE PURCHASE OF CERTAIN
REAL PROPERTY FOR EASEMENTS FOR A WATER TRANS-
MISSION MAIN; AND RESCINDING RESOLUTION NO. 6296.
WHEREAS, ROBERT J. MARSHALL, a married man, who
acquired title as a single man, is the owner of the herein-
after described real property situated in the City of Anaheim,
County of Orange, State of California; and
WHEREAS, the City Council of the City of Anaheim is
desirous of purchasing said property for municipal purposes,
to wit: Easements for a 36 -inch water transmission main; and
WHEREAS, said owner has offered to grant to the City
of Anaheim a permanent easement over, under and across Parcel
No. 1 of said property for the construction, use, maintenance,
repair and inspection of a 36 -inch water transmission main,
and a temporary easement over, under and across Parcel No. 2
thereof for the construction of said water transmission main,
for the amount and upon the terms and conditions hereinafter
set forth; and
WHEREAS, the City Council finds that it is for the
benefit and best interest of the City to accept said offer and
purchase said easements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of ROBERT J. MARSHALL, a
married man, who acquired title as a single man, to sell to
the City of Anaheim a permanent easement over, under and across
Parcel No. 1 hereinafter described for the construction, use,
maintenance, repair and inspection of a 36 -inch water trans-
mission main, and a temporary easement over, under and across
Parcel No. 2 hereinafter described for the construction of said
water transmission main, said parcels being described as
follows:
Commencing at the West quarter corner of Section 4,
Township 4 South, Range 9 West, S.B.B. M., said
quarter corner being in the centerline of Jefferson
Street (60) feet wide), and running thence S. 20 08'
12" W. along the West line of said Section and said
Centerline 41.77 feet; thence S. 87° 51' 48" E.
40.00 feet to the true point of beginning of the
centerline hereinafter described; thence S.
2° 08' 12" W. parallel with said Section line
154.72 feet to a line parallel with and distant
northeasterly 10 feet, measured at right angles,
from the Northeasterly line of the Riverside
Freeway as shown on a Highway Right of Way Map
entitled "Road VII -ORA -175 -B from Sta. 428
73.85 to Jct. ORA -43 -B" dated November 1952,
State of California, Department of Public Works,
Division of Highways, and running thence S. 280
50' 09" E. 104.22 feet along said parallel line
to an angle point therein; thence southeasterly
along said parallel line, said parallel line being
at this point a�curve, the radius point of which
bears 28 14' 48" W. 2096.00 feet from said
angle point; thence southeasterly 266.45 feet
along said parallel line and curve through a central
angle of 17" 17' 01" to a line radial to centerline
station 502 +00 as shown on said Right of Way Map;
thence departing from said parallel line S. 47 °35'
32" W. 269.47 feet to a point in a line radial to
Sta. 504 +57.83 as shown on said Right of Way Map
and in a line parallel with and distant northeasterly
10 feet, measured at right angles, from said North-
easterly lines; thence S. 47° 05' 00" E. along said
parallel line 169.16 feet to the Northerly line of
the Orange County Water District's Santa Ana River
Channel. The sidelines of the above described
20 foot wide strip to be shortened or lengthened
as the case may be so as to terminate in said
Northerly Santa Ana River Channel line.
PARCEL 2:
A strip of land 20 -feet in width, the southerly
line of which is continuous with the northeasterly
line of above described 20 -foot wide Permanent
Easement, last mentioned 20 -foot strip to originate
in a line bearing S. 87° 51' 48" E. from the true
point of beginning of the above described centerline
and to terminate in said Northerly line of the Santa
Ana River Channel.
for the sum of $5,000.00 cash, lawful money of the United States,
be and the same is hereby accepted, subject to the following
terms and conditions.
1. That said sum of $5,000.00, the purchase price
for said property, shall be paid to the Seller
within 30 days after the title to said property
for easement purposes vests in the City of
Anaheim.
2. That the City of Anaheim shall pay the Seller
for any trees located within the temporary
easement, which are actually removed or
damaged to such extent that they need to be
removed, the following amounts:
For all trees 1" in diameter 5.00 each
For all trees 3" to 4" in diameter 30.00 each
For all trees 8" in diameter or over 75.00 each

3. That the City of Anaheim shall place the temporary
easement area in a graded condition upon comple-
tion of the construction of said water trans-
mission main.
4. That the Seller shall recondition the area of
the temporary easement in a stable condition,
the cost of which reconditioning is included
in the total consideration hereinabove mentioned.
5. That said real property to be conveyed for easement
purposes shall be conveyed to the City free and
clear of all encumbrances, except all covenants,
conditions, restrictions, reservations, rights,
rights of way and easements of record approved
by the City Attorney.
6. That said temporary easement shall expire at the
completion of the construction of said water
transmission main.
BE IT FURTHER RESOLVED that the City Auditor be and
he is hereby authorized to pay to Seller within 30 days after
title to said easements vests in the City of Anaheim free and
clear of all encumbrances, except as hereinabove stated, the
sum of $5,000.00 cash, lawful money of the United States.
THE FOREGOING RESOLUTION is approved and signed by
me this 8 th day of November, 1960.
