1960-6414RESOLUTION NO. 6414 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Mary K, Nichols, owner, of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Lot No. 50 of Tract No, 1394 as shown on a map recorded in Book 54, Pages 48 and 49 of Miscellaneoas Maps, Records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on October 3, 1960, notice of which said public hearing was daffy given as required by law and the provisions of Title 18, Chapter 18,76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No, 83 Series 1960► -61, granting variance No, 1297 to permit the non conforming fence to remain on the property, but denying the foster home for mentally retarded children; and WHEREAS, thereafter, within twenty (20) days from the date of the adoption of said resolution, written appeals were filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission granting a portion of said variance and denying a portion thereof, and said appeals were set for public hearing on November 1, 1960, at 7:00 o'clock F.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying the request of Mary K, Nichols to operate a foster home for six mentally retarded children on the property hereinabove described, be and the sane is hereby sustained, and that the action of the City flanning Commission granting the request of the applicant to permit the existing non conforming fence to remain on said property, be and the same is hereby disapproved, and that Variance No. 1297 be and the same is hereby denied.
