1962-0099RESOLUTION NO. 62R -99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TH'.T TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 1 -62 -57 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from l :rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a' summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that .cer- tain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, surimary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 6th day of February 19 62 a the time, and the =7 ham- bers in the City H in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafte} set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its repot of findings, and recommendation; and WHEREAS, the City. Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code shouid be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T :tie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to. wit: -1 61 -62 -57 be excluded from the C -1, NEIGHBORHOOD COMMERCIAL ZONE, and incorporated in the following zone or zones; C -3, HEAVY- OONIIVIERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed substantially in accordance with plans marked "Exhibits Nos. 1 and 2," on file with the City of Anaheim, with the architecture of the proposed service station conforming with the existing Ball Brookhurst Corral Shopping Center. 2. That the owner of subject property shall place of record City of Anaheim C -3 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the use of said property to a service station only. 3. That adequate parking area shall be pro- vided in accordance with the requirements of the Anaheim Municipal Code. The westerly 180.00 feet of the northerly 173.00 feet of Lot 1 of Tract No. 162 as shown on a map thereof recorded in Book 12, page 6 of Miscellaneous Maps, records of Orange County, California, said distances being measured along the northerly and westerly lines of said Lot 1, and said lot lines being 30.00 feet southerly of, and 30.00 feet easterly of the center lines of Ball Road and Brookhurst Street, respectively. That Condition No. 2, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. -2- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
