1962-0098RESOLUTION NO. 62R -98 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING TH T TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of_the City of Anaheim did hold a,public hearing in Reclassification Proceed- ings No. 61- 62 -5,3 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from l rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that .ae— tain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of finding: and recommendation of the City Plan- ning Commission, the City Councii did fix the 6th day of February 19 62 as the time, and the ri ty Council ham bers in the City SETT-in the City of Anaheim as the place fur a public, hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter° aet forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at inaid public hearing before the Planning Commission, its repot of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code •should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T:1e 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des cribed property, situated in the. City of Anaheim, County of Orange, State of California, to. wit: el- 61-62-53 That portion of the Westerly 6 acres of the Easterly one -half of the Northerly one -half of Lot 8 of Anaheim Extension, as shown on a Map of Survey made by William Hamel on file in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the Northwest corner of said Westerly 6 acres and running thence Easterly along the Northerly line of said Westerly 6 acres, 150 feet; thence Southerly parallel with the Westerly line of said Westerly 6 acres, 800.25 feet to the Southerly line of said Westerly 6 acres; thence Westerly along said Southerly line, 150 feet to the Southwest corner of said Westerly 6 acres; thence Northerly along the Westerly line of said Westerly 6 acres, 800.25 feet to the point of beginning. EXCEPTING THEREFROM the following described land: Beginning at the Northwest corner of said Westerly 6 acres and running thence North 74° 371 25 East along the North line of said Westerly 6 acres 150 feet; thence South 15° 20 30" East and parallel with the Westerly line of said Westerly 6 acres, 345 feet; thence South 74° 371 25 West and parallel with said Northerly line 150 feet to said Westerly line; thence North i5° 201 30" West along said Westerly line 345 feet to the point of beginning. be excluded from R -1, ONE FAMILY RESIDENTIAL, ZONE and R -2, T1rWO- FAMILY RESIDENTIAL, ZONE and incorporated in R -3, MULTIPLE FAMILY RESIDENTIAL, ZONE upon the following conditions: 1. That subject property shall be developed substan- tially in accordance with plans marked !!Exhibits Nos. 1 and 2," on file with the City of .Anaheim; provided, however, that in the event of any sub- stantial revision of said plans of development, the revised plans shall be subject to review by the Planning Commission at a public hearing, and to referral to the City Council. 2. That the owners of subject property shall pay to the City of Anaheim the sum or $2.00 per front foot along Broadway for street lighting purposes. 3. (a) That sidewalks and driveways shall be con- structed on Broadway as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said sidewalks and driveways. 4. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 5. That adequate trash storage areas, accessible to trash truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 6. That a 6 -foot masonry wall shall be constructed along the westerly boundary of subject property prior to final building inspection. That the owners of subject property ,shall dedicate ±to the City of Anaheim all vehicular access rights to the stub ends of Oak Street and Chestnut Street, and the alley connecting said streets, inforder to prohibit vehicular access to said streets and said alley connecting said streets. 8. That the owners of subject property shall place of record City of Anaheim R -3 Deed Restrictions, ap- proved by the City. Attorney, which restrictions shall limit the height of all buildings constructed on said property to one story. 9. That Conditions Nos. 2, 3(b), 7 and 8, above men- tioned, shall be complied with within a period of 180 days from date hereof or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
