1962-0097RESOLUTION NO. 62R -97 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 191. WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from REAL ESTATE DISPOSAL CORPORATION, 935 South La Brea, Inglewood, California, to erect a double -faced 14! x 48' outdoor advertising structure, 25 feet above grade on the following described property: All that certain land situated in the State of California, County of Orange, City of Anaheim, described as follows: Commencing at the South one quarter corner of Section 9, Township 4 South, Range 10 West, S. B. B. M., in Orange County, Cal- ifornia, thence South 89° 14! �5" West, along the South line of said Section, 41.87 feet; thence North 46° 57= 35" West 72.24 feet to a point in the North line of the 50 -foot strip of land described in the deed to the State of California recorded February 8, 1935 in Book 730, page 275 of Official Records, thence South 89° 14! 25" West, along said North line, 121.86 feet to the true point of beginning of the boundary of the land herein described; thence South 89° 14f 25 West, along said North line 94.42 feet to the West line of the land des- cribed in the deed to Milton M. Booher and wife recorded May 23, 19)1 in Book 1250, page 456 of Official Records; thence North 0 )Olt 21" West, along said North line 148.12 feet to the Southwesterly line of the land described in the deed to the State of California re- corded April 27, 1954 in Book 2716 page 193 of Official Records thence along said South- westerly line, along a curve concave to the Southwest, having a radius of 1350 feet, through an angle of 7° 19' 22" an arc distance of 172.53 feet, continuing thence along said southwesterly line, South 45° 381 13o West 29 feet to said true point of beginning. EXCEPT the Southerly 10 feet thereof as granted to the State of California for road p 3es by deed recorded March 20, 1956 in Book 311, page 429 of Official Records. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on January 8, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 197, Series 1961 -62, denying Conditional Use Permit No. 191; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim pro- testing the action of the City Planning Commission denying said Conditional Use Permit, and said appeal was set for public hearing on February 6, 1962 at 7:00 o'clock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and therp.rovisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 191 should be denied; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission denying Conditional Use Permit No. 191 be, and the same is hereby sustained, and that the request of REAL ESTATE DISPOSAL CORPORATION, 93,5 South La Brea, Inglewood" California, for a Conditional Use Permit to erect a double -faced 1L x 48' outdoor advertising structure, 25 feet above grade on the property hereinabove described, be, and the same is hereby, denied.
