1962-0081RESOLUTION NO. 62R -81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING Ti ''_T TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of. the City of Anaheim did hold a public hearing in Reclassification Proceed ings No. 61 -62 -48 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the .City Council and that ce r tain.zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the th day of January 19 62 as the time, and the City Council h bers in the City Hein the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exo?uslon of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter et forth; and did give notice t hereof in the manner and form as provided in said Title i8 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its repo, t of r ndings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T:. 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to. wit: 1 61 6 -L18 That portion of the Northeast quarter of the Northeast quarter of Section 15, Township 4 South, Range 11 West, San Bernardino Meridian, described as follows: Beginning at a point in the East line of said Section 15, 264 feet North of the Southeast corner of the Northeast quarter of the Northeast quarter of said Section 15; running thence North 80 feet to a point; thence West 630 feet to a point; thence South NI feet to a point in the South line of the Northeast quarter of the Northeast quarter of said Section 15; thence East 300 feet to a point 330 feet West of the Southeast corner of the Northeast quarter of the North- east quarter of said Section 15; thence North 264 feet to a point; thence East 330 feet to the point of beginning. be excluded from the R-A, RESIDENTIAL AGRICULTURAL ZONE, and into: po-a ed in the following zone or zones: R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the reclassification of subject property under these proceedings is subject to the granting of Conditional Use Permit No. 179 and Variance No. 1420. 2. That subject property shall be developed substantially in accordance with plans marked "Exhibits Nos. 1 and 2," on file with the City of .Anaheim. 3. That landscaping shall be installed and maintained in the proposed entrance way of subject property in accordance with Exhibits Nos. 1 and 2 on file with the City of Anaheim, and that said landscaping shall be installed prior to final building inspection. 4. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street along Knott Avenue, for street widening purposes. 5. (a) That all engineering requirements of the City of Anaheim, along Knott Avenue, such as curbs and gutters, sidewalks, street grading and paving, drain- age facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. -2- 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Knott Avenue for street lighting purposes. 7. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit to be used for park and recreation purposes, said amount to be paid at the time the the building permit is issued. That adequate trash storag areas; accessible to trash truck pickup, sha Y be provided, as determined and required by the Street, Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 9. (a) That a 6 -foot masonry wall shall be con- structed around the entire perimeter of subject property in accordance with the requirements of the Anaheim Municipal Code; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said wall as and when required by, the City Engineer, but in any event, within a period of 'eighteen months from date hereof. 10. That plans for the installation of carports shall be submitted to and approved by the Building and Planning Departments of the City; and That the rear wall of the proposed carports may be constructed on the location of the wall re- quired by the Anaheim Municipal Code, in which event said rear wall shall be equivalent, at least to a 6 -foot masonry wall. 11. That Conditions Nos. 4, 5(b), 6 and 9 (b), above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
