1962-0076RESOLUTION NO. 62R -76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING TFiLT TITLE 18 OF THE ANAHEIM MUNICIPAL OODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61-62-61 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p ;arsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the. City Council and that ,ce tain. or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, sur!mary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 2rd day of January 19 62 as the time, and the City Council ham bers in the City Hein the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title i8 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at acid public hearing before the Planning Commission, its.repoct of I ndings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code•sh.ouid be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council.of the City of Anaheim that Tale 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -61 The northerly one -half of the southerly one -half of Lot 15 in Block "K" of the Kraemer Tract, as said Lot 15 is shown on a map recorded in Book 12, Pages 87 and 88 of Miscellaneous Records of Los Angeles County, California. EXCEPTING from said land the southerly 202.10 feet. ALSO EXCEPTING from said land all that portion lying easterly of the westerly line of that certain parcel of land, of varying widths, described in the final order of condemnation, a certified copy of which was recorded August 10, 1961 in Book 5812, Page 934 of Official Records of said Orange County, California. be excluded from the R-A, RESIDENTIAL- AGRICIJi.T1JRAi ZONE, and incorporated in the following zone upon the conditions hereinafter set forth: That a strip of land 50 feet in width, lying east of and contiguous to the land to be deeded to the City of Anaheim along Dowling Avenue, shall be incorporated in P -L, PARKING-LANDSCAPING, ZONE; and That the remainder of subject property shall be incorporated in M -1, LIGHT. MANUFACTURING ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibit No. 1," on file with the City of Anaheim. 2. That landscaping shall be installed and main- tained in the P -L, PARKING- LANDSCAPING ZONE; that plans for said landscaping shall be sub- mitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim; and that said landscaping shall be installed prior to final building inspection. 3. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Dowling Avenue for street widening purposes. 4. That all engineering requirements of the City of Anaheim, along Dowling Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as -2- or zones, required by the City Engineer and in accord- ance with standard plans and specifications on file in the office of the City Engineer; and that said engineering requirements shall be complied with at the time subject property is developed. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Dowling Avenue for street lighting purposes, said amount to be paid at the time subject property is developed. That the owners of subject property, re_cog- nizing the obligation to deed to the City of Anaheim a 10 -foot drainage and public utility easement, have agreed to and shall comply with the following requirements in lieu of dedicating a drainage easement: That said owners shall deed to the City of Anaheim an easement for public utility purposes over and across the southerly five feet of subject property, and shall enter into an agreement, to run with the land, guaranteeing to hold the City harmless from any liability for damages to subject property and /or ad- joining properties as a result of the,Cityts obligation for drainage. Said agreement shall be approved by the City Attorney and the City Engineer and shall be placed of record in the Office of the County Recorder of Orange County. 7. That Conditions Nos. 3 and 6, above mentioned, shall be complied with within a period of 180 days from date hereof or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
