1962-0029RESOLUTION NO. 62R -29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING Ti TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THEā€¢BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of. the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 -62 56 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p:.:rsons interested therein and from its staff; and 61 -62 -56 -1- WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the City Council and that cer twin, zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 9th day of Januar, 19 62 as the time, and the 777 ham bersn a yty Hall in the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it Is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title i8 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at .a .id pub] is hearing before the Planning Commission, its repo, t of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Tie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: A11 that portion of the Southeast quarter of the Northeast quarter of Section 17, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana and the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in book 51, page 10, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the intersection of the center line of Broadway with the center line of Euclid Avenue, as shown on the map of Tract No. 2402, recorded in book 79, pages 37, 38 and 39, Miscellaneous Maps, records of said Orange County, and running thence North 89° 02 50" West along the center line of Broadway, 245.01 feet to an intersection with the Northwesterly extension of the East line of Lot 71 of said Tract No. 2402; thence South 0 32 15" West, along said Northwesterly extension and along the boundary line of said Tract No. 2402, 319.26 feet to the North line of Lot 64 of said Tract No. 2402; thence South 89 02 50" East, along the North line of Lots 64 and 72 of said Tract No. 2402, and the Easterly extension thereof, 245.01 feet to an inter- section with said center line of Euclid Avenue; thence North 0 321 i5 East, along said center line, 319.26 feet to the point of beginning. EXCEPTING THEREFROM the northerly 45 feet and the easterly 53 feet for street purposes. be changed from R -A, RESIDENTIAL AGRICULTURAL, ZONE to the following zones, upon the conditions hereinafter set forth: That the south 150.00 feet of the north 195.00 feet of the west 150.00 feet of the east 203.00 feet of the above described property be changed to C -3, HEAVY-COMMERCIAL ZONE; and That the remainder of subject property be changed to C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed substan- tially in accordance with plans marked "Exhibits 1 and 2" on file with the City of Anaheim, with a landscaped strip of a minimum width of six feet provided along the Euclid Avenue and Broadway Street frontages of the C -1, Neighborhood Commercial Zone property. That plans for landscaping said strip of land shall be submitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim, and that said landscaping shall be installed prior to final building inspection. 2. That a masonry wall, six feet in height from the grade level of the abutting properties, shall be installed along the south and west boundaries of subject property prior to final building inspection. 3. That the owners of subject property shall place of record City of Anaheim C -3 and C -1 Deed Restric- tions covering the respective parcels, approved -2- by the City Attorney, which restrictions shall limit all buildings constructed on subject pro- perty to one story in height, and shall limit the use of the C -3, Heavy Commercial Zone, portion of subject property to a service station or any C -1, Neighborhood Commercial Zone, uses. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Broadway for street widening purposes, and shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Avenue for street widening purposes. 5. (a) That all engineering requirements of the City of Anaheim, along Broadway and Euclid Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Broadway and Euclid Avenue for street lighting purposes. 7. That Conditions Nos. 3, L, 5(b) and 6, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
