1962-0028RESOLUTION NO. 62R -28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING THLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of. the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No 61- .62'45. to consider an amendment to the Title 18 o Anaei hm Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from y:rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the. City Council and that :very tain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 9th day of January 19 62 as the time, and the City Council ham bers in the City Hein the City of Anaheim as the place fur a public, hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter SF:t forth; and did give notice thereof in the manner and form as provided in said Title i8 of said Anaheim Municipal. Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at .na.id public hearing before the Planning Commission, its :repot of Endings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Tale 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: 61.62-54 That portion of the Southwest quarter of the South- west quarter of Section 5, in Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on a map thereof recorded in book 51, page 10, Miscellaneous Maps, records of said Orange County, described as follows: The Southerly 281.00 feet of the following: Beginning at the Southwest corner of Lot 157 of Tract No. 2093 as shown an a map thereof recorded in book 76, pages 45 to 48 inclusive, Miscellaneous Maps, records of said Orange County; thence South T 0 21= 35" East 640 feet to the South line of said Section 5; thence North '89 46t 20" East along said South line 255.73 feet to the Southerly prolongation of the Westerly line of Lot 1 of said Tract No. 2093; thence North 0 21! 35" West 640 feet to the Southeast corner of Lot 159 of said Tract No. 2093; thence South 89 46' 20" West 255.73 feet to the point of beginning. be excluded from the R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incorporated in the C -1, NEIGHBORHOOD- COMMERCIAL ZONE, subject to the following conditions: 1. That subject property shall be developed substantially in accordance with, plans marked "Exhibits 1 and 2" on file with the City of Anaheim. 2. (a) That a 6 -foot masonry wall shall be constructed along the east boundary of subject property, and that a 6 -foot ornamental masonry wall shall be constructed along the north boundary of said property. (b) That a bond in an amount and form sat- isfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said walls. 3. That tree wells shall be installed in the parkway portion of subject property abutting La Palma Avenue; that a strip of land 6 feet in width abutting the front property line shall be landscaped and said landscaping maintained, and that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim. That said landscaping shall be installed prior to final building inspection. 4. That the owners of subject property shall place of record City of Anaheim C -1, Neighborhood Commercial Zone, Deed Restrictions, approved by the City Attorney, which restrictions shall limit the use of subject property to business at professional offices only. -2- STATE OF CALIFORNIA COUNTY OF ORANGE ss. WILLIAMS, City Clerk of the City of Anaheim, do hereby certify that the foregoing Resolution No. 62R -28 was introduced and adopted at a regular meeting provided by law, of the City Council of the City of Anaheim, held on the 9th'day �f January, 1962, by the folldwing' vote of the members thereof: AYES: COUNCILMEN: Chandler, Coons, Fry, Thompson and ScIiutte. -NOES: COUNCILMEN: None. ABSENT: COUNCILMEN: None. AND I FURTHER that the Mayor of the City of Anaheim approved and signed said Resolution -No. 62R -28 on the 9th day of January, 1962. That the owners of subject property shall deed to the City of Anaheim an easement for public utility purposes over a strip of land 5 feet in width along the westerly boundary of subject property. 9. That adequate areas for trash storage and pickup shall be provided as determined by the Director of Public Works and Super- intendent of Streets,which areas shall be enclosed by a solid fence or wall. 10. That the owners of subject property shall dedicate to the City of Anaheim the access rjhts to Lotus Street and Glen Avenue on the north side of subject property. 11. That Conditions Nos. 2(b), L., 5, 6, 7(b), 8 and 10 shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. THE FOREGOING RESOLUTION is approved and signed by me this 9th day of January, 1962. AT ST O /.A 5. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along La Palma Avenue, for street widening purposes. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2 per front foot along La Palma Avenue, for street lighting purposes. 7. (a) That sidewalks and driveways shall be installed on La Palma Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form sat- isfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said sidewalks and driveways.
