1962-0018RESOLUTION NO. 62R -18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 2nd day of January 1962, as the time, and the City oouncil Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or .zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: 61 -62 -51 The Easterly 339 feet of the Westerly 660 feet of the Southerly 160 feet of the Northerly rectangular 378 feet of that portion of Lot 2 in Block K of the Kraemer Tract, in the City of Anaheim, as shown on a map thereof recorded in book 12, pages 87 and 88, Miscellaneous Records of Los Angeles County California, described as follows: Beginning at a point distant 38.10 rods Westerly, measured at right angles from a point in the Easterly line of said lot, said latter point being 70 rods Southerly from the Northeasterly corner of said lot; thence Southerly, parallel to the Easterly line of said lot, 42 rods; thence Westerly, parallel to the.Northerly line of said lot, 41.90 rods to a point in the Westerly line of said lot; thence Northerly along said Westerly line 42 rods; thence Easterly, parallel to the Northerly line of said lot, 41.90 rods to the point of beginning. be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE, to the following zones, upon the conditions hereinafter set forth: That a strip of land 50 feet in width lying west of and contiguous to the land to be deeded to the City of Anaheim along Miller Street, for street widening purposes, be changed to P -L, PARKING LANDSCAPING ZONE; and That the remainder of said property be changed to M -1, LIGHT MANUFACTURING ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street along Miller Street, for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim, along Miller Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other ap- purtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements at the time the property is developed, but in any event within a period of two years from date hereof, unless further time is granted by the City Council. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Miller Street, for street lighting purposes, said amount to be paid at the time the property is developed. (a) That a 6 -foot masonry wall shall be constructed along the north, west and south boundaries of sub- ject property; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction -2- Anaheim January, affixed January, (SEAL of said wall at the time the property is developed, but in any event within a period of two years from date hereof, unless further time is granted by the City Council. That the P -L, PARKING LANDSCAPING ZONE, area shall be landscaped, and said landscaping maintained; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 6. That Conditions Nos. 1, 2(b) and 4(b) above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper..
