1962-0016RESOLUTION NO. 62R -16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. f1 -62 -3 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p. :rsons interested therein and from: its staff; and WHEREAS, within a period of forty days foi said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a. summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the .City Council and that tain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, sur!mary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 2nd day of January 19 62 as the time, and the i�ty i l ham= bers in the City H'in the City of Anaheim as they place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described from the zone in which it is now situated and the incorporation thereof in the zone hereinafter s :t forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at s aid public hearing before the Planning Commission, its repot of findings, and recommendation; and WHEREAS, the City.Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Tie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des cribed property, situated in the. City of Anaheim, County of Orange, State of California, to wit: 61- 62 -1:..3 All that certain real property situated in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, described as follows: Beginning at a point 49.25 feet South of the Northwest corner of the South one -half of the Northwest quarter of the Northwest quarter of Section 12, in Township L. South, Range 10 West, San Bernardino Base and Meridian, and running thence South along the West line of said Northwest quarter, 85 feet; thence East 150 feet; thence North, parallel with the West line of said Northwest quarter, 85 feet; thence Wiest, 150 feet to the point of beginning. be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and ingotpo'ated in the following zone or zones; C -1, NEIGHBORHOOD- COMMERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibits 1 and 2" on file with the City of Anaheim; provided, however, that a landscaped strip of a minimum width of six feet shall be provided, and said landscaping maintained, along the highway right of way line, and that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance of the City of Anaheim. That said landscaping shall be installed prior to final building inspection. 2. That the owner of sOject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Placentia Avenue for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim, along Placentia Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other ap- purtenant work shall be complied with as re- quired by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. That the owner of subject property shall pay -2- That adequate areas for trash storage and pickup shall be provided as determined by the Director of Public Works and Superintendent of Streets, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 6. That Conditions Nos. 2, 3(b) and 4, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
