RESOLUTION NO. 62R 329
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DECLARING AND ESTABLISHING
ADMINISTRATIVE PROCEDURES FOR HANDLING
INHABITED ANNEXATIONS, AND DIRECTING THE
CITY CLERK TO FORWARD REQUESTS THEREFOR
DIRECTLY TO THE CITY PLANNING COMMISSION
FOR ITS APPROPRIATE ACTION.
WHEREAS, prior to the commencement of any proceedings
under the Annexation Act of 1913 consent of the legislative body
must be obtained and in cities having a planning commission,
such consent shall not be given pursuant to Government Code
Sections 35106 and 35107 until the legislative body has received
a report or recommendation from such commission; and
WHEREAS, any proceedings initiated under the Annexation
Act of 1913 would be referred to the City Planning Commission
by the City Council before the Council would give its consent
to any inhabited annexation; and
WHEREAS, it is the intention of the City Council to
expedite requests of inhabited areas to be annexed to the City
by having the City Clerk automatically refer such requests to the
City Planning Commission for its report or recommendation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that, in each instance where proponents initiate
proceedings to annex inhabited territory to the City of Anaheim,
the City Clerk be, and she is hereby, directed to transmit each
such request immediately upon receipt of the same to the City
Planning Commission for its report or recommendation and to transmit
a copy thereof to the City Council at its next regular meeting
for its information pending the report or recommendation of said
Commission.
THE FOREGOING RESOLUTION is approved and signed by me
this 3rd day of April, 1962.
