1962-0301RESOLUTION NQ. 62R -301 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61- 62 -79, to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a reso- lution containing a report of its findings, a summary of the evidence presented at said hearing and a recommendation that a portion of the property described in said resolution be changed to a different zone, and that a change of zone for the remaining portion of said property be denied; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission, the City Council did fix the 27th day of March, 1962, as the time, and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in a different zone or zones, and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that a portion of the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth, and that the remaining portion of said property should remain in the zone in which it is now incorporated; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -79 PARCEL 1: The East 314.00 feet of the Southeast quarter of the Southeast quarter of the Northeast quarter of Section 15, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, as shown on a map thereof recorded in Book 51, Page 11, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the North 473.26 feet thereof; ALSO EXCEPTING THEREFROM the East 202 feet. PARCEL 2: The West 181 feet of the East 495 feet of the Southeast quarter of the Southeast quarter of the Northeast quarter of Section 15, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim as shown on a map thereof recorded in Book 51, Page 11, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the North 264.00 feet thereof. be changed from R -A, RESIDENTIAL- AGRICULTURAL ZONE to R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following condi- tions: 1. That the above described property shall be developed substantially in accordance with plans marked "Exhibits Nos. 1, 2 and 3" on file with the City of Anaheim, subject, however, to the written approval of the Fire Chief of the City of Anaheim. 2. That the reclassification of the above described property under these proceedings is contingent upon the granting of Conditional Use Permit No. 203 permitting the establishment of a planned unit development on said property, and permitting the establishment of a service station on the property hereinafter described. 3. That a 6 -foot masonry wall shall be constructed along the west, north and the 209 -foot pardon of the easterly boundary line of the above described property, prior to final building inspection. 4. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Orange Avenue for street widening purposes. 5. (a) That all engineering requirements of the City of Anaheim, along Orange Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. -2- 6. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 7. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Orange Avenue for street lighting purposes. 8. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Depart- ment, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 9. That Conditions Nos. 4, 5(b) and 7 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. BE IT FURTHER RESOLVED that the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The East 202.00 feet of the Southeast quarter of the Southeast quarter of the Northeast quarter of Section 15, in Township 4 South, Range 11 West, partly in the City of Anaheim, in the Rancho Los Coyotes, as shown on a map thereof recorded in Book 51, Page 11, Miscellaneous Maps, records of said Orange County; EXCEPTING THEREFROM the North 473.26 feet thereof. remain in R -A, RESIDENTIAL- AGRICULTURAL ZONE, in which it is now incorporated, and that the reclassification to C -3, HEAVY COMMERCIAL ZONE, be denied.
