A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL
AND AWARDING A CONTRACT TO THE LOWEST RE-
SPONSIBLE BIDDER FOR THE FURNISHING TO THE
CITY OF ANAHEIM OF 7 VERTICAL TURBINE -TYPE PUMPING UNITS
FOR DELIVERY AT THE LOCATION OF THE LINDA VISTA RESERVOIR
BOOSTER STATION APPROX. 625' NORTH OF ANAHEIM RD.AND APPROX
200' WEST OF THE EASEMENT KNOWN AS LINDA VISTA, W.O. #4068.
WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed published and circulated in the City of Anaheim, to
wit: The Anaheim Bulletin, on February 27th and March 6th,
1962, a notice inviting sealed proposals for furnishing to
the City of Anaheim the following equipment:
Seven (7) Vertical Turbine -Type Pumping
Units, including all mechanical, hydraulic,
electric and miscellaneous equipment for
said pumping units, in accordance with
the specifications and drawings on file
in the Office of the City Engineer, Work
Order No. 4068.
AND WHEREAS, such notice inviting proposals for said
pumping units did provide that said sealed proposals would be
received by the City of Anaheim at the Office of the City Clerk
of said City up to the hour of 2 :00 o'clock P.M. on March 15,
1962, for the furnishing to said City of said pumping units; and
WHEREAS, the City Clerk of the City of Anaheim did
receive sealed proposals prior to 2 :00 o'clock P.M. on March 15,
1962, for the furnishing of said pumping units, which proposals
were opened on said date in public, in the City Council Chambers
in the City Hall, in the City of Anaheim, by the City Clerk and
the City Engineer, and duly tabulated by the City Engineer and
the result thereof reported to the City Council at its next
regular meeting, for action thereon by said City Council. That
sealed proposals were received from the following persons,
firms or corporations in the amounts set forth:

AND WHEREAS, the City Council does find that the sealed
proposal of PEERLESS PUMP, HYDRODYNAMICS DIVISION, FMC CORPORATION,
301 West Avenue 26, Los Angeles 31, California, is the lowest
responsible bid for the furnishing of vertical turbine -type pumping
units specified in the notice inviting sealed proposals and in
accordance with the specifications and drawings on file in the
Office of the City Engineer, and that said proposal of PEERLESS
PUMP, HYDRODYNAMICS DIVISION, FMC CORPORATION, should be accepted
and a contract awarded to said corporation for furnishing said
pumping units to the City of Anaheim;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that said proposal submitted by the PEERLESS
PUMP, HYDRODYNAMICS DIVISION, FMC CORPORATION for the furnishing
of vertical turbine -type pumping units, as specified in the notice
inviting sealed proposals therefor and in accordance with and in
conformity to the specifications and drawings for said pumping
units on file in the Office of the City Engineer, be, and the 'same is
hereby,accepted and that a contract for the furnishing of said
pumping units be, and the same is hereby, awarded to said PEERLESS
PUMP, HYDRODYNAMICS DIVISION, FMC CORPORATION; and
BE IT FURTHER RESOLVED that said PEERLESS PUMP, HYDRO-
DYNAMICS DIVISION, FMC CORPORATION, be, and it is hereby,required
to execute a contract, in required form satisfactory to the City
of Anaheim and upon the terms and conditions specified in the
notice inviting sealed proposals and the proposal submitted by
it, and in accordance with the drawings and specifications for
for vertical turbine -type pumping units on file in the Office of
the City Engineer for said pumping units, at the prices as follows:

AND BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that said bid be, and the same is hereby, accepted
and said contract awarded for the above prices for said pumping
units, F.O.B. the Linda Vista Reservoir Booster Station located
approximately 625 feet north of Anaheim Road and approximately
200 feet west of the easement known as Linda Vista (said easement
being approximately along a southerly extension of Linda Vista
Street from Orangethorpe Avenue), in the County of Orange, said
pumping units to be delivered not earlier than 160 days and not
later than 180 days from date hereof.
BE IT FURTHER RESOLVED that the Mayor and the City Clerk
of the City of Anaheim be, and they are hereby, authorized and
directed to execute for and on behalf of the City of Anaheim with
said PEERLESS PUMP, HYDRODYNAMICS DIVISION, FMC CORPORATION, a
written contract for the furnishing of said pumping units here
inabove set forth and in accordance with the specifications and
drawings for said pumping units on file in the Office of the
City Engineer, the notice inviting sealed proposals and the
terms of this resolution, and the contract approved by the City
Attorney of the City of Anaheim; and
BE IT FURTHER RESOLVED that said contract shall con-
tain a provision that should said PEERLESS PUMP, HYDRODYNAMICS
DIVISION, FMC CORPORATION fail or neglect to furnish said
pumping units in accordance with said specifications and drawings
and the sealed proposal submitted by it and accepted by the
City as herein specified, it shall, in addition to any other
penalties provided in the contract documents, be liable to
the City of Anaheim for all loss or damage that the latter may
suffer on account thereof.
THE FOREGOING RESOLUTION is approved and signed by
me this 20th day of March, 1962.
