1962-0223RESOLUTION NO. 62R -223 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of. the City of Anaheim did hold a public hearing in Reclassifi:eation Proceed- ings No. 61 6:2 76 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from p:.rsons interested therein and from its staff; and WHEREAS, within a. period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a' summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the.City Council and that .dere tain. zone or zones be changed as hereinafter'set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 13th day of March 19 62 as the time, and the City Council ham- bers in the City Hein the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter et forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its:repo,t of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the.. zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that 18 of the Anaheim M unicipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim', County of Orange, State of California, to wit: el- 61-62-76 Lots 140 to 145, both inclusive, of Tract No. 2779 as shown on a map recorded in Book No. 92, Pages 36 to 40, both inclusive, of Miscellaneous Maps, Records of Orange County, California. be excluded from R -3, MULTIPLE- FAMILY RESIDENTIAL, ZONE and incorporated in C-1, NEIGHBORHOOD COMMERCIAL, ZONE upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibits Nos. 1 and 2" on file with the City of Anaheim. 2. That a landscaped strip, of a minimum width of six feet, shall be provided and maintained abutting the planned highway right of way line on Euclid Street; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 3. That the uses of subject property shall be limited to business and professional offices only. 4. That the owner of subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of subject property to business and professional offices only, and shall limit the height of all buildings constructed on subject property to one story. 5. That the owner of subject property shall dedicate to the City of Anaheim all vehicular access rights to Euclid Street and Chalet Avenue, EXCEPT for two access drives on Euclid Street and one access drive on Chalet Avenue. 6. That the owner of subject property shall dedicate to the City of Anaheim all vehicular access rights to the existing alley on the west side of subject property. 7. That a block wall, of a minimum height of 3 feet, shall be constructed along the westerly boundary of subject property prior to final building in- spection. 8. That use of existing structures on subject property shall be subject to the approval of the Chief Building Inspector. 9. That the owner of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Euclid Street for street widening purposes. 10. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, -2- which areas shall be enclosed by a solid fence or wall prior to final building inspection. 11. That Conditions Nos. 4, 5, 6, and 9, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
