1962-0219RESOLUTION NO. 62R -219 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TFLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed= ings No, 61 -62 -71 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from vrsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the. City Council and that E taro zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 13th day of March 19 62 as the time, and the 7177 Council ham= bers in the City Hein the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone In which it is now situated and the incorporation thereof in the zone hereinafter s :t forth; and did give notice thereof in the manner and form as provided in said Title i8 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public: hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its repo, t of (hidings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council.of the City of Anaheim that Tlie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des cribed property, situated in the_ City of Anaheim, County of Orange, State of California, to wit: -1- 61 -62 -73 That portion of the west half of the west half of the southwest quarter of the southwest quarter of section 12, Township 4 South, Range 11 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as per map recorded in book 51, page 11 of Miscellaneous maps, in the office of the county recorder of said county, lying northerly of a line bearing South 89° 31 45" East from a point on the West line of said section 12, North 0 12 15" West 765.00 feet from the southwest corner of said section 12. EXCEPT that portion thereof lying northerly of the following described line: Beginning at a point on the West line of said section, southerly 97.25 feet from the northwest corner of said west half; thence easterly in a direct line to a point on the East line of said West half, southerly 97.25 feet from the northeast corner of said West half. ALSO EXCEPT that portion thereof described in the deed to the State of California, recorded May 28, 19L1, in book 1093 page 534 of Official Records. be excluded from R-A, RESIDENTIAL- AGRICULTURAL, ZONE and incorporated in C -1, NEIGHBORHOOD- COMMERCIAL, ZONE upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibits Nos. 1 and 2" on file with the City of Anaheim. 2. That a 6 -foot masonry wall shall be constructed along the northerly and easterly boundaries of subject property, except for the area occupied by the existing residence, and that said wall shall be constructed prior to final building inspection. 3. That the existing residence on subject property shall be used for residential purposes only, with no combined residential and commercial use permitted. 4. That the existing residence on subject property shall be removed at such time as the residential use thereof is discontinued, at which time a 6 -foot masonry wall shall be constructed on the easterly boundary of the area occupied by said residence, thereby providing a continuous block wall along the entire easterly boundary of subject property. 5. That a landscaped strip of a minimum width of 6 feet shall be provided and maintained along the entire frontage of subject property; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. -2- 6. (a) That all engineering requirements of the City of Anaheim, along Stanton Avenue and Beach Boulevard, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. That the owner of subject property shall pay to the City of +Anaheim the sum of $2.00 per front foot along Stanton Avenue and Beach Boulevard, for street lighting purposes. 8. That the owner of subject property shall deed to the City of Anaheim a 10 -foot easement for public utility purposes along the westerly boundary of subject property. 9. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sani- tation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 10. That Conditions Nos. 6(b), 7, and 8, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
