1962-0216RESOLUTION NO. 62R -216 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 200. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from the LUTHERAN HOME ASSOCIATION OF CALIFORNIA, 891 South Walnut Street, Anaheim, California, for a Conditional Use Permit to permit an estab- lished home for the aged and and allow construction of new buildings on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: All of Lots 17, 18 and that portion of Lot 19 of Anaheim Investment Company's Tract, in the city of Anaheim, as shown on a map thereof recorded in book 7, pages 33 and 34, Miscellaneous Maps, re- cords of said Orange County, described as a whole as follows: Beginning at a point in the center of Ball Road distant thereon North 89° 37' 29" East 260.00 feet from the intersection of said center line with the Southerly prolongation of the Easterly line of Lot 22 of Tract No. 1421, as shown on a map thereof recorded in book 62, pages 13 to 16 inclusive, Miscellaneous Maps, records of said Orange County, and running thence North 0° 18? 02" West 671.28 feet to a point in the North line of said Lot 19 which is distant thereon North 89° 35' 11" East 257.50 feet from the intersection of said North line with the East line of Lot 32 of said Tract No. 1421; thence South 89° 35' 11" East, along the North line of said Lots 19, 18 and 17, a distance of 745.53 feet to the Northeast corner of said Lot 17, said Northeast corner being in the center line of Walnut Street as shown on said map; thence South 0 19' 18" East, along the East line of said Lot 17, said Southeast corner being the intersection of the center lines of Walnut Street and Bali Road as shown on said map; thence South 89° 37' 29u West, along said center line of Ball Road, 745.77 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on February 5, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 222 Series 1961- 62, granting Conditional Use Permit No. 200, upon the condi- tions therein set forth; and -1- WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting said Conditional Use Permit and said appeal was set for public hearing on March 13, 1962, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as re- quired by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Com- mission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detri- mental to the particular area nor to the peace, health, safety and general welfare. L. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW,THEREF0RE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting said Conditional Use Permit be, and the same is hereby sustained, and that Conditional Use Permit No. 200 be, and the same is hereby, granted permitting the expansion of an existing home for the aged situated on the property hereinabove described, subject to the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibit No. 1" on file with the City of Anaheim; provided, however, that plans for the future development of an additional 75 units on the westerly portion of subject property shall be submitted to the City Planning Commission for approval. -2- 2. That parking facilities shall be provided as required by the Anaheim Municipal Code, said parking facilities to be provided on the site of subject property. 3. That the owner of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Bali Road on the westerly 1012 feet (approximately) of subject property, for street widening purposes. That the owner of subject property shall deed to the City of Anaheim a strip of land 36 -1/2 feet in width, from the center line of the street, along Bali Road on the east 160 to 200 feet (approximately) of subject property, for street widening purposes. 5. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot on Ball Road for street lighting purposes. 6. That sidewalks shall be installed along the westerly 368 feet (approximately) of the Ball Road frontage of subject property as required by the City Engineer and in accordance with stand- ard plans and specifications on file in the Office of the City Engineer. That sidewalks, four feet in width, shall be installed along the easterly 27.. feet (approximately) of the Bali Road frontage of subject property as required and approved by the City Engineer. 8. That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said side walks mentioned in Conditions Nos. 6 and 7 hereof. 9. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 10. That Conditions Nos. 3, 4, 5, and 8, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
