1962-0198RESOLUTION NO. 62R-198 A RESOLUTION OF THE CITY COUNCIL OF THE CITY. OF ANAHEIM FINDING AND DETERMINING T FiLT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 61 -62 -71 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from r; :rsons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon, the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evi- dence presented at said hearing and a recommendation that the proposed amendment be adopted by the. C i t y Council and that tain. zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Councii did fix the 27th day of February 19 62 as the time, and the 7177 Council :ham- bers in the City Hein the City of Anaheim as the place fur a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zone hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal. Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its repot or Cnding and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in Which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that T:.ie 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that the following des- cribed property, situated in the. City of Anaheim, County of Orange, State of California, to. wit: -1- 61 -62 -71 The West 210 feet of the North one -half of the North one -half of the Northwest quarter of the Southwest quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, city of Anaheim, as shown on a map thereof recorded in book 51, page 11, Miscellaneous Maps, records of said Orange County. be excluded from the R -A, RESIDENTIAL AGRICULTURAL ZONE, and incorporated in C -1, NEIGHBORHOOD- COMMERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans marked "Exhibit No. 1" on file with the City of Anaheim. 2. That a 6 -foot masonry wall shall be construc- ted along the east and south boundary lines of subject property prior to final building inspection. 3. That a landscaped strip of a minimum width of 6 feet shall be established and maintained abutting the planned highway right of way line of Knott Avenue on that portion of sub- ject property proposed to be developed at the present time; that plans for said lands- caping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. That at the time of development of the northerly half of subject property, for any C -1, Neighborhood Commercial, Zone uses, a landscaped strip of a minimum width of 6 feet shall be established and maintained along the highway right of way lines of Orange and Knott Avenues, in accordance with the above procedure. That plans for the development of said northerly portion of subject property shall be subject to the approval of the Planning Commission. 4. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Knott Avenue for street widening purposes, and shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Orange Avenue, for street widening purposes. 5. (a) That all engineering requirements of the City of Anaheim, along Knott and Orange Avenues, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance -2- with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 6. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Knott and Orange Avenues, for street sighting purposes. 7. That adequate areas for trash storage shall be provided as determined and required by the Street Maintenance and Sanitation Diviskn of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 8. That Conditions Nos. t, 5(b), and 6, above mentioned, shall be complied with within 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
